SUMMARY
The applicant is requesting a recommendation of approval for a New Series 12 (Restaurant) liquor license.
Recommendation
Recommend approval to the Arizona Department of Liquor Licenses and Control (DLLC) of Application No. 184099, a request by Teressa Miller, agent for Ocho Rios Jerk Spot, for a New Series 12 liquor license. Ocho Rios Jerk Spot is located at 13291 W. McDowell Rd., Goodyear, Arizona 85338, generally located on the Southwest corner of Dysart and McDowell Road. (Darcie McCracken, City Clerk)
FISCAL IMPACT
The applicant paid the $635 application fee for the liquor license per the Goodyear Municipal User Fee Schedule. The business will also contribute to the tax base of the community.
BACKGROUND AND PREVIOUS ACTIONS
Ms. Miller has applied for a New Series 12 liquor license for Ocho Rios Jerk Spot, which is currently under construction with an anticipated opening date in July 2022. Ocho Rios Jerk Spot will be a full-service restaurant and is the 2nd location in the Phoenix Metro Area, with the other restaurant located in Phoenix.
The City Clerk's Office received the application from the Arizona Department of Liquor Licenses and Control on May 6, 2022. A public notice was posted on the property on May 9, 2022, to comply with Arizona Revised Statutes §4-201(b). The applicant paid the $635 application fee for the liquor license. No petitions or protests from qualified persons were received during the comment period.
The application was routed to the Police Department and the Development Services Department (Planning and Zoning, Code Compliance, and Building Safety), and any comments from these departments are listed below:

STAFF ANALYSIS
A Series 12 license is for a restaurant and is non-transferrable. This on-sale retail privileges liquor license allows the holder to sell and serve all types of spirituous liquor solely for consumption on the premises of an establishment that derives at least forty percent (40%) of its gross revenue from the sale of food. The DLLC requires license owners, agents, and managers actively involved in the day-to-day operations of the business to complete a state-approved management training course prior to the issuance of a liquor license. Ms. Miller states that they have completed the required training and a manager will be present on-site during all business hours. She also stated that, in addition to asking for identification from anyone who appears to be under 40 years of age, all staff will be trained to understand and follow the guidelines of Arizona liquor license laws to avoid selling alcohol to minors.
