SUBJECT: PROPOSALS TO TOHONO O'ODHAM NATION FOR ARIZONA REVISED STATUTE 5-601-02 12% GAMING DISTRIBUTION FUNDS

SUMMARY

The Tohono O'odham Nation is seeking requests for funding proposals from Arizona cities and non-profit organizations for their 2022 State Shared Revenue grant program. Proposals must address one or more of the following priority areas: education, healthcare, public safety, child advocacy, economic development, or cultural and environmental development and protection. Responses are due no later than June 10, 2022.

Recommendation

ADOPT RESOLUTION NO. 2022-2252 AUTHORIZING THE SUBMISSION OF THREE APPLICATIONS FOR STATE SHARED REVENUE GRANT PROGRAM REQUESTING ECONOMIC DEVELOPMENT, HEALTH CARE, AND PUBLIC SAFETY FUNDS TO THE TOHONO O'ODHAM NATION, AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS RELATING TO SAID APPLICATIONS, AND AUTHORIZING THE CITY MANAGER TO EXECUTE A GRANT AGREEMENT (IF GRANT FUNDS ARE AWARDED), AND AUTHORIZING THE CITY MANAGER TO APPROVE THE REQUIRED BUDGET TRANSFER (IF GRANT FUNDS ARE AWARDED). FISCAL IMPACT

If awarded budget transfers will be made to accommodate expenditures associated with the receipt of additional revenue from the Tohono O'odham Nation. Projects not fully funded through the grant process will be scaled back to grant award amount, not pursued at this time or seek other funding.

BACKGROUND AND PREVIOUS ACTIONS

In 2002, Arizona eligible voters approved Proposition 202, which implemented a new requirement that Tribal/State Gaming Compacts must include a provision that the compacting tribe would contribute a portion of its annual net gaming revenues (the "Annual Contribution") for the benefit of the general public. Pursuant to Proposition 202, each tribe may determine the recipients of 12 percent of its total Annual Contribution (the "State Shared Revenue grant program").

In April, these projects/applications were authorized for submittal to the Gila River Indian Community.

The Tohono O'odham Nation has announced a request for proposals from local governments and non-profit organizations for the distribution of the fiscal year 2022 payments. Responses are due via email no later than June 10, 2022.

STAFF ANALYSIS

As was indicated by the Gila River Indian Community, a representative for the Tohono O'odham Nation also confirmed that the three applications would be reviewed independently and will compete in different categories (economic development, health care, and public safety) and not directly against each other.

Since award determinations are at the discretion of the funder and there is never a guarantee of an award, let alone full funding, for grant applications, staff would like to pursue both prospective grant opportunities simultaneously.

In the unlikely event that both applications are fully funded for any of these projects, the project would be scaled to maximize the sum of awarded resources.

The following projects desire to move forward with an application:
  • Engineering – support for the citywide effort to eliminate scalloped streets, $500,000
  • Parks – expand the market for a Goodyear tourism campaign, $100,000
  • Fire – for cancer screening of sworn and fire investigation employees over the age of 40, $300,000 (over three years)
Funded applications will be notified in August 2022. Funds will be available in October/November 2022.
