SUMMARY
Declaring a public street for a section of Harrison Street located within city-owned property.
Recommendation
ADOPT RESOLUTION NO. 2022-2258 DECLARING AS PUBLIC RIGHT-OF-WAY CITY-OWNED PROPERTY LOCATED WITHIN A SECTION OF THE HARRISON STREET ALIGNMENT; REQUIRING RECORDATION; AND PROVIDING FOR AN EFFECTIVE DATE. (Linda Beals, Real Estate Coordinator)
FISCAL IMPACT
This declaration of right-of-way will have no immediate fiscal impact on the city. The city would have been required to declare the property as right-of-way when it developed the fire station site at the northeast corner of Citrus Road and Harrison Street. Upon their completion and acceptance by the city, the city ultimately will be responsible for maintaining the improvements constructed within the property being declared as right-of-way.
BACKGROUND AND PREVIOUS ACTIONS
Meritage Homes of Arizona, Inc. owns and is in the process of developing Silva Trails, a residential development. Silva Trails will be developed in phases, and a final plat for the development of Phase 1 (the Silva Trails at West Goodyear – Phase 1 Final Plat) is being presented by separate action concurrently with this request. As part of the development of Phase 1 of Silva Trails, the owner will be constructing full half-street improvements for the north half of Harrison Street location within its property. This section of Harrison will be connected to the existing south-half of Harrison Street located between Citrus Road and the section of Harrison Street along the southern boundary of Silva Trails by a pavement taper. The pavement taper will be located within city-owned property located within the Harrison Street alignment that was acquired for a fire station to be located at the northeast corner of Citrus Road and Harrison Street.
STAFF ANALYSIS
When the city develops the fire station, the city will be required to construct full half-street improvements for the north half of Harrison Street between Citrus Road and Silva Trails and declare the portion of the property where the improvements are located as public right-of-way. The pavement taper that is to be constructed by the adjacent property owner will be located within the portion of the city property that will ultimately be declared as public right-of-way. Declaring the portion of the city-owned property located within the Harrison Street alignment that is needed for the pavement taper will allow the development of Phase 1 of Silva Trials to proceed. For these reasons, staff recommends the adoption of Resolution 2022-2258.
