SUMMARY

A Final Plat subdividing approximately 36.57 acres into 160 lots and 12 tracts at the intersection of S. Citrus Road and W Broadway Road.

STRATEGIC PLAN ALIGNMENT

RECOMMENDATION

Conditionally approve the Final Plat of El Cidro Phase 2, Parcel 1C subdividing approximately 36.57 acres generally located near the northeast corner of S. Citrus Road and W. Broadway Road into 160 lots and 12 tracts, subject to stipulations. (Marty Crossland, Deputy Director of Development Engineering)

STIPULATIONS

1. Any technical corrections to this final plat required by the City Engineer or his  designee shall be made prior to the recordation of the Final Plat;
 
2. Prior to recordation of the Final Plat for El Cidro Phase 2 Parcel 1C (the “Final Plat”), the dedication language dedicating the streets and conveying the tracts to the HOA shall be revised as follows:                                                                   
LS-GOODYEAR LLC, A DELAWARE LIMITED LIABILITY COMPANY, HEREBY DEDICATES, GRANTS, AND CONVEYS TO THE CITY OF GOODYEAR, IN FEE, THE STREETS DESIGNATED AS “R/W DEDICATED HEREON” SHOWN ON THIS FINAL PLAT AND INCLUDED IN THE PREMISES DESCRIBED HEREIN.

LS-GOODYEAR LLC, A DELAWARE LIMITED LIABILITY COMPANY HEREBY DECLARES TRACTS A THROUGH L (A-L), INCLUSIVE, AS SHOWN ON THIS THIS FINAL PLAT AND INCLUDED IN THE PREMISES DESCRIBED HEREIN AS COMMON AREAS FOR THE USE AND ENJOYMENT OF THE MEMBERS OF THE EL CIDRO HOMEOWNERS ASSOCIATION, AN ARIZONA NON-PROFIT CORPORATION AND, SUBJECT TO THE EASEMENTS GRANTED HEREIN AND THE COVENANTS, RESERVATIONS, RESTRICTIONS AND EASEMENTS IMPOSED UPON SUCH TRACTS, CONVEYS TO EL CIDRO HOMEOWNERS ASSOCIATION, AN ARIZONA NON-PROFIT CORPORATION, TRACTS A THROUGH L (A-L), INCLUSIVE, WITHIN THIS FINAL PLAT FOR THE PURPOSE INDICATED HEREIN AND AS MORE FULLY SET FORTH IN THE DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS AND EASEMENT.
 
3. The Final Plat for El Cidro Phase 2 Parcel 1C shall not be recorded until all of the City Council has abandoned the right of way and/or easement conveyed to the City over the areas reflected in the legal description in the document titled Legal Description for El Cidro Right-of-Way Abandonment attached hereto.
 
4. Prior to recordation of the Final Plat, Owner shall submit an updated title report for the property included within the Final Plat prepared after council has approved the abandonment of the right of way and termination of easement described above and after all documents effectuating the abandonment and termination have been recorded in the official records of the Maricopa County Recorder.

5. Prior to recordation of the Final Plat shall be modified to reflect the current ownership and current lender as reflected in the updated title report that is to be provided, and a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the property being platted herein.

6. Prior to recordation of the Final Plat, Owner shall provide documentation acceptable to the City Attorney or his/her designee demonstrating that the persons executing the Final Plat are authorized to do so.

7. The property owner shall be required, at owner’s sole cost and expense, to relocate any and all utility infrastructure located within the Abandonment Area as described in the attachment hereto.

FISCAL IMPACT

Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.

BACKGROUND AND PREVIOUS ACTIONS

The preliminary plat of El Cidro was approved by the City Council on February 26, 2016.

STAFF ANALYSIS

As set forth in the attached preliminary plat Council Action Report, the proposed subdivision is consistent with the General Plan and will not adversely impact the surrounding area. Further, the proposed subdivision is consistent with the technical requirements of the city’s subdivision regulations and engineering standards, and provides for the orderly development of the property by identifying the required infrastructure needed to serve the development. The Final Plat is in substantial conformance with the Preliminary Plat.
