| SUBJECT: | APPROVE PLANS AND SPECIFICATIONS AND AWARD CONTRACT TO ONYX PAVING COMPANY, INC., FOR CONSTRUCTION OF THE ANNUAL SIDEWALK AND CURB ACCESS RAMP IMPROVEMENTS FISCAL YEAR 2021-2023, CITY PROJECT NO. 1-R-22

RECOMMENDATION:
That the City Council
A. Approve Plans and Specifications for the Annual Sidewalk and Curb Access Ramp Improvements Fiscal Year 2021-2023, City Project No. 1-R-22;
B. Award construction contract for the Annual Sidewalk and Curb Access Ramp Improvements Fiscal Year 2021-2023, City Project No. 1-R-22 to Onyx Paving Company, Inc., of Anaheim, California, in the amount of $373,000.00 and reject all other bids; and,
C. Approve and authorize the City Manager to execute an agreement with Onyx Paving Company, Inc., of Anaheim, California, in the amount of $373,000.00; and authorize staff to issue a purchase order to Onyx Paving Company, Inc., of Anaheim, California, in the amount of $447,600.00, which includes a 20 percent contingency.
DISCUSSION:
The proposed Annual Sidewalk and Curb Access Ramp Improvements Fiscal Year 2021-2023 Project consists of, but not be limited to the following work elements: mobilization, preparation and implementation of stormwater best management practices; traffic control; safety and cleanup; construction staking and monument perpetuation; in addition to the reconstruction of PCC sidewalks, curb ramps, curbs, gutters and driveways; root pruning; and all other incidental work as indicated on the plans, specifications, and contract documents.
On Tuesday, April 11, 2023, at 3:00 p.m., the City received seven (7) bids with the following results:

The apparent lowest bid was submitted by Onyx Paving Company, Inc. in the amount of $373,000.00, which is approximately 21% lower than the engineer’s estimate of $453,500.00. Staff completed a thorough review of Onyx Paving Company, Inc.'s bid, as well as their references, and found their construction services to be satisfactory. Onyx have completed similar projects for the cities of Dana Point, Laguna Niguel, and Arcadia; additionally, there has been no indication or records of excessive change order requests from the contractor. Onyx has also completed two projects in the last few years for the City of La Habra, including Parking Lot Improvements FY 19-20 and Alley Improvements No. 6, 44, 48, and 79 FY 19-20 without any issues. Additionally, the City recently awarded two construction projects to Onyx, including the current construction of a new Community Center parking lot and construction of the City's Annual Residential Street Rehabilitation and Slurry Seal Project to start in May 2023. Onyx currently maintains a valid Contractor’s License.
FISCAL IMPACT/SOURCE OF FUNDING:
This project is included in the Fiscal Year 2022-2023 Capital Improvement Program (CIP) with a total approved budget of $650,000 (Gas Tax Fund); therefore, sufficient funding has already been appropriated to complete the construction of the Annual Sidewalk and Curb Ramp Improvements Fiscal Year 2021-2023 Project, City Project No. 1-R-22.
