SUBJECT:
APPROVAL OF AWARD OF CONTRACT TO MICON CONSTRUCTION, INC., FOR THE WOMAN'S CLUB PARK PROJECT, CITY PROJECT 1-P-22, AND CONSIDER NAMING THE NEW PARK

RECOMMENDATION:


That the City Council:
A. Approve the plans and specifications for the Woman's Club Park Project, City Project No.1-P-22;

B. Award a construction contract for the Woman's Club Park Project, City Project No.1-P-22, to Micon Construction, Inc., of Placentia, California, in the amount of $1,559,982 and reject all other bids;

C. Authorize the City Manager to execute an agreement with Micon Construction, Inc., and issue a purchase order in the amount of $1,871,978.40 which includes a 20 percent contingency;

D. Approve an appropriation of $279,057 from the General Capital Projects fund balance to fully fund the Woman's Club Park Project, City Project No 1-P-22; and,

E. Consider naming the new park based on recommendations by the La Habra Woman's Club, the City's Planning Commission, and the City's Community Services Commission.  

DISCUSSION:

This City-owned site consists of approximately 30,938 square feet of undeveloped land at 200 West Greenwood Avenue. The site was formerly occupied by the clubhouse for the La Habra Woman’s Club; however, the building and parking lot were removed in 2018 and the site is now an empty lot enclosed by a vinyl perimeter fence. On March 30, 2020, the City successfully secured a Proposition 68 grant in the amount of $861,400 to develop a new park at this location. The proposed park will include a demonstration garden, trees, a playground area, a central picnic area, benches, a walking path, decorative lighting, and landscaping throughout the park. The new walkable park is intended to serve the La Habra community with these amenities and enrich the quality of life for residents in the surrounding neighborhoods.

After years of planning and design, Staff is ready to award a contract for the construction of the proposed park. In February 2024, the City released a Notice Inviting Bids for the construction of the Woman's Club Park Project. On March 13, 2024, staff received the following bids:

Staff reviewed the lowest bid from Micon Construction, Inc. and found their bid to be responsive. Staff reviewed Micon Construction's references and found their record of performance to be satisfactory, with no record of excessive or unreasonable change orders initiated by the contractor. On April 8, 2024, staff sent a Notice of Intent to Award to Micon Construction, Inc. notifying them that the City will be recommending a contract award to their company. Staff is recommending that the City Council award a construction contract to Micon Construction, Inc., authorize the City Manager to execute an agreement (Attachment No. 3), and appropriate $279,057 from the General Capital Projects fund balance to fully fund construction, construction management, design support, and material testing services. 

Per City Council's policy for the naming of public facilities, staff presented a list of potential park names to the Community Services Commission and the Planning Commission. The list was ranked in order of preference based on suggestions from members of the La Habra Woman's Club:
  1. Las Reinas Park (Queens Park)
  2. Las Doñas Park (The Ladies Park; Doñas is a Spanish term for a woman that indicates seniority)
  3. Las Soñadoras Park (The Daydreamers Park)
  4. Las Damas Park (The Ladies Park)
  5. Jardín de Las Damas (The Ladies Garden)
On February 8, 2023, the Community Services Commission reviewed the Woman’s Club’s recommendations and heard testimony from the Woman’s Club’s representatives regarding the naming of the park. The Commission accepted the Woman’s Club’s recommendation to name the park "Las Reinas Park" and voted unanimously 5-0 to send the recommendation to the City Council. However, since that time, the Woman’s Club has decided that they now prefer that the park be named “Woman’s Club Park” to honor the history of the Woman’s Club and its location for many years. On March 13, 2023, the Planning Commission reviewed the Community Services Commission and Woman's Club's recommendations for the naming of the park, and voted 3-0 in favor of naming the park "Las Doñas Park" and forwarded the proposal to the City Council for ultimate approval. Attached to this report are the Planning Commission Minutes.

Staff recommends that the City Council review the recommendations made by the La Habra Woman's Club, the City's Planning Commission, and the City's Community Services Commission and provide direction to Staff regarding the name of this new park. 

FISCAL IMPACT/SOURCE OF FUNDING:

The Project is included in the Fiscal Year (FY) 2023-2024 Capital Improvement Program (CIP) with a total approved budget of $1,861,400. To date, the City has spent $127,435 on planning and design. Despite receiving a high number of bids for the construction portion of the project, the lowest cost presented by Micon of $1,559,982 is higher than what was budgeted, and totals $1,871,978.40 when including the 20 percent contingency. It should be noted that the Micon bid does not include additional project costs related to construction management, design support or material testing services that may be necessary.

In order to provide sufficient funding to complete all components of this project, staff recommends that the City Council appropriate $279,057 of available General Capital Projects funds to fund construction, as well as construction management, design support and material testing.
