RECOMMENDATION:
That the City Council:
A. Approve the Plans and Specifications for Corona Park Shade Structure, City Project No. 1-P-23 ("Project");
B. Award a construction contract for the Corona Park Shade Structure, City Project No. 1-P-23, to Western State Builders, Inc., of Escondido, California, in the amount of $70,236 and reject all other bids;
C. Approve an appropriation of $5,500 from the Park Acquisition Fund balance to complete the necessary funding for this project; and,
D. Authorize the City Manager to execute an agreement with Western State Builders, Inc., of Escondido, California, in the amount of $70,236, and authorize staff to issue a purchase order to Western State Builders, Inc. of Escondido, California, in the amount of $77,260; which includes a ten percent (10%) contingency.

DISCUSSION:
The proposed Corona Park Shade Structure Project, City Project No. 1-P-23 consists of installing a shade structure at Corona Park, located at 735 5th Avenue. The base bid includes the installation of a hip shade structure that will help protect children and park visitors from light rain and direct sunlight, in addition to extending the life of the playground equipment. The City advertised the Project to include an additive/alternative bid item for a mariner shade structure that is more architectural in style and aesthetically pleasing, which promotes a much more fun and inviting environment to the park. As an example, the Brio Park playground currently has the mariner shade structure in place, whereas the Portola Park playground has the basic hip shade structure. On February 15, 2023, the City of La Habra received a total of six bid proposals for the project, as follows:

Staff reviewed the proposals from all six bidders and found Western State Builders, Inc., total bid to be the lowest responsive bid. Their base bid in the amount of $46,819 and the additive/alternative bid amount of $23,417 resulted in a combined total bid of $70,236. Based on the proposal pricing, staff recommends that the City Council approve the installation of a mariner shade structure instead of a more basic hip shade structure. The references that Western State Builders, Inc. provided were found to be satisfactory, and prior projects that were completed for other clients were found to be of similar scope. In addition, there was no record of excessive change orders initiated by the contractor, and they maintain a valid Contractor's license. In order to provide sufficient funding to complete this project, with the mariner style shade structure, staff recommends that the City Council approve the appropriation of an additional $5,500 from the Park Acquisition Fund to complete the funding necessary for this project, which includes a ten percent contingency.
FISCAL IMPACT/SOURCE OF FUNDING:
This Project is included in the Fiscal Year 2022-2023 Capital Improvement Program (CIP) with a total approved budget of $75,000 from the Parks Acquisition Fund. Staff recommends that the City Council appropriate an additional $5,500 from available Park Acquisition Fund reserves for this Project to fully fund the construction, contingency, and material testing costs. If approved, the revised Project budget will be as follows:
