| SUBJECT: | APPROVE AN AGREEMENT WITH TROLLER MAYER ASSOCIATES, INC. FOR DESIGN SUPPORT DURING THE CONSTRUCTION OF THE WOMAN'S CLUB PARK PROJECT, CITY PROJECT NO. 1-P-22

RECOMMENDATION:
That the City Council:
A. Approve and authorize the City Manager to execute an agreement with Troller Mayer Associates, Inc., of Glendale, California in the amount of $55,494 to provide design support during the construction of the Woman's Club Park Project, City Project No. 1-P-22; and,
B. Approve and authorize staff to issue a purchase order to Troller Mayer Associates, Inc. of Glendale, California, in an amount not-to-exceed $61,044, which includes a ten percent (10%) contingency.
DISCUSSION:
On December 6, 2021, the City entered into an agreement with Troller Mayer Associates, Inc. for Landscape Architectural and related services for the design of the proposed new park at the former Woman's Clubhouse site at 200 West Greenwood Avenue. The proposal included a variety of services, including the development of two design alternatives for the park, preliminary engineering, project plans, specifications, and contract documents. The agreement expired on December 31, 2023.
Construction of the new park at the former Woman's Clubhouse site is slated to start in early Summer 2024. Staff will require design support during construction from the Architect who designed the plans; therefore, staff requested Troller Mayer Associates, Inc. ("Troller Mayer") for a proposal to provide these services. The scope of services includes technical assistance during construction of the Project in order to verify that the project will be constructed in accordance with the approved plans and specifications including, but not limited to, reviewing material submittals, responding to Requests for Information (RFIs), reviewing drawings for conformance with the Project plans and specifications, and other technical design services as needed within the authorized budget.

Staff reviewed Troller Mayer's proposal and, considering Troller Mayer's prior work in designing this park and developing its plans for construction, recommends that City Council waive the competitive bidding process per the City's Municipal Code Section 4.20.080 "Exceptions to Bidding Requirements" for the purchase of certain professional services allows the procurement of services for which professional policies prohibit competitive bidding, such as, but not limited to, architectural services, consultant services, legal services and engineering services, allowing staff to negotiate for the provision of such services.

FISCAL IMPACT/SOURCE OF FUNDING:
Funding for the Project is included in the approved fiscal year 2023-2024 CIP budget. There are sufficient budget funds to cover the costs associated with the proposed consultant design services.
