RECOMMENDATION:
That the City Council:
A. APPROVE AND ADOPT RESOLUTION NO. CC 2026-__ ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA HABRA, CALIFORNIA, ADOPTING A POLICY ADDRESSING DISRUPTION OF TELEPHONIC OR INTERNET SERVICE DURING PUBLIC MEETINGS; and
B. APPROVE AND ADOPT RESOLUTION NO. CC 2026-__ ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA HABRA, CALIFORNIA, DETERMINING REASONABLE EFFORTS TO ENCOURAGE PUBLIC PARTICIPATION IN MEETINGS PURSUANT TO GOVERNMENT CODE § 54953.4.
DISCUSSION:
Senate Bill 707 (SB 707) amended the Brown Act to require eligible legislative bodies to adopt, on or before July 1, 2026, a policy addressing how the agency will respond to disruptions in telephonic or internet service that prevent members of the public from attending or observing a meeting remotely. This policy establishes procedures for responding to a disruption in the telephonic or internet services that provide two-way remote public access to meetings of the La Habra City Council as required by the amended Brown Act (Gov. Code § 54953.4). The policy further ensures transparency, public participation, and continuity of government during technology disruptions.
SB 707 further requires the City to make reasonable efforts to invite groups that do not traditionally participate in public meetings to attend those meetings. Reasonable efforts to encourage participation in public meetings include media outreach, multilingual communication, and use of existing communication channels, as outlined in the Reasonable Outreach Resolution (Attachment 3).
Therefore, staff recommends that the City Council approve the Technology Disruption Resolution and Policy (Attachments 1 and 2), as well as the Reasonable Outreach Resolution (Attachment 3) in order to comply with the requirements of SB 707 for the assurance of continuity of public participation during technical disruptions. A copy of SB 707 has also been provided for review (Attachment 4).

FISCAL IMPACT/SOURCE OF FUNDING:
Sufficient funds are budgeted in the proposed Fiscal Year 2026-2027 City Clerk budget to comply with changes in public meetings as a result of the passage and implementation of SB 707.
