Ordinance adopting and enacting a new Code for the City of Mankato, providing for the repeal of certain ordinances not included therein; providing a penalty for the violation thereof; providing for the manner of amending such Code; and providing when such code and ordinance shall become effective, and Resolutions authorizing Summary Publication of ordinance and adopting an updated Fee Schedule.

Recommendation/Action(s):

Adoption of the attached ordinance/new code and adoption of the attached resolutions.

Summary:

The City of Mankato recently completed the process of a full recodification of the City Code, which is detailed below:
  • The initial stage involved having the entire code reorganized, which involved a comprehensive review and rearrangement of each chapter and digital conversion of the material into the standard Municode format for purposes of later editing, styling, numbering, and publication in print and on the internet. With this, for example, Liquor is currently Chapter 4 and will become Chapter 3 (all new numbering/references).
  • A code attorney then conducted a review to identify conflicts, inconsistencies, and obsolete ordinance provisions in connection with State Statutes, as amended through the most recent legislative session.
  • A panel consisting of three Council members met and reviewed a high-level summary of the revisions as well as a listing of items needing further review.  
  • As part of this project, all references to the City Code (i.e., notices, letters, licenses, offense codes, signage, etc.) will need to be revised accordingly.
  • We are now in the final stages, which include implementation, and a model-adopting ordinance for us to adopt the new code (see attached).
In addition, during the process most references to fee amounts within the code were removed and referenced "as provided in the city fee schedule". With this, revisions have been made to the fee schedule to incorporate such changes as well as to update the fees that reference cannabis registrations that were previously approved, as there were several categories that were not needed and could be removed. 

Also, during the process, there were several chapters identified as needing further review and possible amendments. Moving forward, these areas will be addressed with any modifications being brought forward for approval.
