Discussion and possible action on any and all matters regarding possible amendment to Chapter 152 of the City Code of the City of San Luis, Zoning Regulations, to amend the Light Industrial Zoning District to allow the refining, processing, or packaging of agricultural or edible food products as a conditional use and possible action of instructions to staff for such a staff initiated amendment to the Zoning Regulations and/or a staff initiated conditional use permit to allow such a use. SUMMARY:
A company is exploring setting up a food processing enterprise to produce fig products. The company is looking at two locations 1.) business incubator and 2.) San Luis Cooling. Both locations are located at the industrial park and would need configurations of their facilities to include a kitchen, food range, and sinks for cleaning. The approximately leasing space would be 3,000-4,000 square feet.
Under the current zoning regulations, this use is allowed only in a Heavy Industrial District and only with a conditional use permit. Staff believes this is too restrictive and such a use can be permitted in the Light Industrial District as a conditional use. Using the procedure of a conditional use permit will allow the City to be certain that the specific proposed use will be appropriate for the proposed location and allow specific conditions to be placed to be certain that the use will be appropriate.
In addition, staff is seeking permission for a staff-initiated conditional use permit for said fig food processing operation. If Council agrees, it is the intent of staff to allow the use to go forward prior to the amendment of the zoning regulations followed by the process of the granting of a conditional use permit. The legal process to amend the code followed by the process of issuing a conditional use permit can take up to 6 months. There is a business looking to presently locate within the City and it is felt that if Council approves, the economic development opportunity that is presenting itself should not be lost. Any such permission will be contingent on Council approving an amendment to the City Code and Council approving a future conditional use permit.

RECOMMENDATION / SUGGESTED MOTION:
I MOVE TO INSTRUCT STAFF, AS POLICY, TO PROCEED WITH A STAFF-INITIATED AMENDMENT TO THE ZONING REGULATIONS ON THE LIGHT INDUSTRIAL ZONING DISTRICT TO ALLOW THE REFINING, PROCESSING, OR PACKAGING OF AGRICULTURAL OR EDIBLE FOOD PRODUCTS AS A CONDITIONAL USE, AND, ONCE AMENDED, TO AUTHORIZE A STAFF-INITIATED APPLICATION FOR A CONDITIONAL USE PERMIT FOR A USE FOR THE FOOD PROCESSING AND PACKAGING OF FIGS INTO EDIBLE FOOD PRODUCTS.
