ITEM:

Discussion and possible action on any and all matters regarding the ratification of a cost increase for the Cesar Chavez Bridge Repair Project.  (Eulogio Vera, Acting Director of Public Works)

SUMMARY:

The Cesar Chavez Bridge Repair Project was procured via emergency procedures as a Job Order Contract (JOC), using the City of Yuma JOC.  Using the City of Yuma Contract is permitted under the San Luis City Code-Purchasing Section 36.09, Cooperative Purchasing because the City of Yuma used a competitive process, and it is not likely that better pricing can be obtained by going through the process again. Arizona State law does not require a bidding process for road construction if the cost is under $241,140 law bidding is not required. Due to the urgency of the situation, it is appropriate for the City Council to waive formal procedures under San Luis City Code-Purchasing Section 36.01(H).
 
Emerging conditions during contract execution resulted in the need for two changes, with a net increase in contract cost of $40,800.  Change order number 1 consisted of extending the water line casing under the bridge to clear the bridge, so if a leak were to occur in the future, we wouldn't have to disturb the bridge to repair the waterline.  The first change order also included breaking holes through the bridge approach slab in order to inject a concrete slurry to backfill voids under the approach slab.  Change order number 2 consists of a deduction for the slab repair.  The contractor originally proposed to repair half of the slab width; however, they ultimately repaired only a quarter of the slab based on the structural engineer's recommendation.  Following consultation with the City Attorney and Finance Director, the City Administrator concurred in moving forward with the changes as an emergency action.  City Council ratification of the cost increase is now required.

RECOMMENDATION / SUGGESTED MOTION:

I MOVE TO APPROVE AND RATIFY THE CESAR CHAVEZ BRIDGE REPAIR CONTRACT MODIFICATIONS FOR $40,800.00, AND
THE TOTAL CONTRACT COST OF $117,300.00 AND ALSO 
WAIVE FORMAL PURCHASE PROCEDURES DUE TO THE URGENT NEED TO REPAIR THE BRIDGE.

A budget transfer is not required, as available funds are already aligned under Water Fund G/L # 300-302-90015. Overall funding (for both the original contract and this modification) is available via cost avoidance of an approved CIP project (Water Storage Tank Rehabilitation Project) that couldn’t be executed this year due to COVID-19 considerations.
