Discussion and possible action on any and all matters regarding revised Ordinance No. 433. An ordinance of the Mayor and City Council of the City of San Luis, Arizona, amending City Code § 10.15.235, titled, Parking in Alleys; continuing the penalty for violations under City Code § 10.15.990; repealing any conflicting provisions and providing for severability. SUMMARY:
Background
This item was on the City Council's Meeting agenda for December 28, 2022, but was continued so that affected residents could be notified, and a Work Session could be arranged. The Planning and Zoning Department sent out 126 letters to affected residents. City Council held the Work Session on March 1, 2023, and the only members from the public were the press.
Safety and Service Issues with parking in alleys
Fire trucks cannot get through the alleys in an emergency if cars are parked, obstructing their path. The city’s solid waste collection trucks cannot pick up and empty trash containers in alleys where vehicles are parked. So the city's sanitation workers must manually roll out the trash containers in order to empty them, delaying service. Police need to have the alleys free of cars to rapidly respond or have alternative access to intervene in life-threatening circumstances.
The Changes in Ordinance No. 433 to San Luis City Code 10.15.235
Subsection (A) removes allowing parking in alleys if there is clearance of feet (10'). Instead, it prohibits parking in alleys in the area bounded by Urtuzuastegui Street, 4th Avenue, Cesar Chavez Boulevard, and William Brooks Avenue as the most critical area.
For clarity, prohibiting blocking driveways is removed from subsection (A) into its own subsection (B).
The Ordinance adds a subsection to clarify that there is no stopping, standing, or parking where prohibited by traffic signs or if otherwise prohibited by law. An example of other laws would be obstructing traffic or creating a nuisance.
