ITEM:

Discussion and possible action on any and all matters regarding Ordinance No. 355. An ordinance of the Mayor and City Council of the City of San Luis, Arizona authorizing Exchange of Real Property for Wastewater Diversion Lift Station Project; and declaring an emergency.  (Eulogio Vera, Public Works Director)

SUMMARY:

In April 2014, the City of San Luis purchased a 100' x 100' parcel from Mr. Jimmie D. Smith, President of Somerton Farming Company, to be used for the placement of a new sewer lift station.  Design of said lift station didn't get started until July 2014.  During design, a new location for the lift station was recommended.  City staff agreed with designer's recommendation for the new location since it would generate over $50,000.00 in savings due to a closer proximity to the existing infrastructure.  This land exchange ordinance would take care of the land exchange and cover any additional expenses associated with the transaction. It is requested that this be adopted as an emergency measure to allow construction of this vital sewer lift station as soon as possible.

Under San Luis City Code Section 30.79, three fourths (3/4) vote of all seven (7) members of City Council are required to pass as an emergency, which is six (6) votes of the City Council.  

RECOMMENDATION / SUGGESTED MOTION:

1. I MOVE TO APPROVE READING OF ORDINANCE NO. 355 BY TITLE ONLY. 
2. I MOVE TO APPROVE AND ADOPT  ORDINANCE NO. 355 AND DECLARE AN EMERGENCY.

Funds for the land exchange will be paid out of the Utility Bond Funds for Waste Water Act # 310-311-90015.350 with a remaining balance of $2,773,573.00
