The purpose of this Intergovernmental Agreement (IGA) is to improve traffic circulation and improve means of access to San Luis Middle School, Arizona Desert Elementary School, and Rio Colorado Elementary School in the area of 4th Avenue and Union Street.  The area between 4th Avenue and the schools belongs to the State.  This IGA will provide for a joint application to obtain access and allow the City to widen and improve their streets in the area and the school to build a road to access the schools. State law provides for a five-year window to build the road or the access reverts back to State ownership.  The IGA provides that if the road is not built within that time, the School is agreeing to the City blocking access to the area to prevent trespassing.  The recommended motion is to approve subject to final form of agreement because we are working with the School's legal council on last details of current liability and the engineering work for the legal description for the exhibits is not yet completed.  However, the IGA is substantially finished and staff  requests this approval so as not to delay the project and related funding.
