Discussion and possible action on any and all matters regarding the first reading of proposed Ordinance 339. An ordinance of the Mayor and City Council of the City of San Luis, Arizona, amending Ordinance Number 229 to allow the imposition of an annual business license fee for Arizona-registered medical marijuana businesses; repealing any conflicting provisions; and providing for severability. SUMMARY:
The San Luis City Code Section 110.03(B) (passed as Ordinance 229 in 2005) prohibits the City of San Luis from charging certain nonprofit entities a license fee. The State of Arizona requires medical marijuana businesses to be nonprofit under A.R.S. § 36-2804.06. City Code 110.03(B) as it stands does not allow license fees for nonprofits which have Federal tax exemption status. Medical marijuana businesses do not have such status now. However, in order to make perfectly clear that the City has the ability to impose a license fee on Medical Marijuana businesses, staff requests this amendment to the City Code, the printed copy is attached to this agenda item.

I MOVE TO APPROVE FIRST READING OF ORDINANCE 339 BY TITLE ONLY.
