ITEM:

Discussion and possible action on any and all matters regarding Resolution No. 1105.  A resolution of the Mayor and Council of the City of San Luis, Arizona, approving an Addendum to the the Intergovernmental Agreement (IGA) between the City of San Luis and Yuma County for the purpose of providing mandated Weekend and Holiday Municipal Court Services.  (Rosendo Morales, Jr., Municipal Court Judge)

SUMMARY:

The City of San Luis has entered into an intergovernmental agreement (IGA) with Yuma County and its Justice Court to provide for weekend and holiday coverage for the municipal court.  Under Rule 4.1 of the Arizona Rules of Criminal Procedure, if a person is arrested, it is mandated that person must be brought before a judge within 24 hours even on weekends and holidays.  So, under this IGA Yuma County helps with coverage on weekends and holidays as needed to have a judge and other necessary personnel such as Court Interpreter etcetera as well as materials to conduct the hearings. The current contract started in the year 2011 for costs in the 2010-2011 fiscal year and the City has approved the costs yearly since then.  Under the contract, the City pays the County based on case loads calculated during the fiscal year.  The cost started at $2,187.11 in 2011 and has stayed under $2,500.00. The County is requesting that Council approve the Addendum for the cost calculated for last fiscal year in the amount of $2,313.08.

RECOMMENDATION / SUGGESTED MOTION:

I MOVE TO APPROVE AND ADOPT RESOLUTION 1105.
