Discussion and possible action on any and all matters regarding the contract between the City of San Luis and Sound Talent Group for a musical performance for the 4th of July Celebration event.  (Lizandro Galaviz, Director of Parks & Recreation)

The Parks & Recreation Department has strived in providing our community with great entertainment for our 4th of July festivities. This year, staff is working very hard to continue to amaze our community with great musical performances that make their 4th of July experience memorable.  With last year's event being held virtually, this year that we are able to have a live event once again, staff wants our community to have an amazing and memorable experience.  Currently, staff has been in communication with Sound Talent Group who is the booking agency for Mexican Band de Rock en Español, Kinky, who staff would like to headline the 2021 Fourth of July Celebration.  Kinky is a Rock en Español Band from Monterrey, Mexico who have been in the music industry since 2000.  They currently have several albums with great hits such as A Donde Van Los Muertos, Marcha Atras and Despues Del After and Sister Twisted. 

If the City Council decides to recommend moving forward with the musical guests mentioned above, staff would like to consider Sound Talent Group, to be the sole source provider since they are the Authorized Booking Agent for the Rock en Español Band, Kinky.  Musical artists are unique, therefore under Purchasing Code § 3.05.020, Exclusive Services, where Sound Talent Group is the sole provider in booking the Rock en Español Band, Kinky, other quotes or bidding is not required. Staff is requesting the City Council to approve the contract between the City of San Luis and professional Rock en Español Band, Kinky, whose authorized booking agent, Sound Talent Group, for the 2021 Fourth of July Celebration.

If this request of sole source provider is to be approved, staff is requesting to use a prepaid account to pay the deposit of $10,000.00.  Per the Performance Agreement Section 3: Compensation, as compensation for such concert, the city shall pay on or before the end of the first set the performance on the date of the concert the agent, a total fee of twenty thousand U.S, dollars ($20,000.00). The city agrees to pay one-half (1/2) of this fee on Thursday, June 10, 2021, and the remainder on Sunday, July 4, 2021, before 10:00 pm.
