ITEM:

Discussion and possible action on any and all matters regarding Ordinance No. 437. An Ordinance of the Mayor and City Council of the City of San Luis, Arizona repealing San Luis City Code Section 5.15.090 border area taxi vehicle permit and regulations; and providing for severability.  (Glenn Gimbut, Assistant City Attorney)

SUMMARY:

On December 2019, City Council approved and amended City Code Chapter 112, which was later changed to City Code Section 5.15, "Transportation Business Regulations" to provide a border area and a system of issuance and regulation for border area vehicle permits to park at Taxi Stands or a wait at Taxi Waiting Stands within said border area. 

As result, San Luis City Code Section 5.15.090 states that each taxicab stopping, standing, or parking at either a border area taxi stand or a border area taxi stand or a border area taxi waiting stand shall be required to have a border area taxi vehicle permit. The permit covers the designated vehicle and cannot be transferred to another vehicle. However, to obtain a border area taxi vehicle permit, an applicant must meet certain requirements. Such requirements include: the taxicab business applying for a border area taxi vehicle permit must have at least five (5) taxicabs registered to their current business, must provide a dispatch service to its taxicabs from a central location, and have an office within the City limits and in a commercial zone.

Also, no more than 35 border area taxi vehicle permit shall be issued by the City and no more than five (5) border area taxi vehicle permits shall be issued to any single taxicab business. The border area taxi vehicle permits are valid only for the calendar year in which they were issued and needed to be renewed the following year. 

The proposed ordinance seeks to repeal Section 5.15.090 of the San Luis City Code and remove the border area taxi vehicle permits. By doing so, all taxicab companies, with an active business license, will be able to stop, stand, and park on any border area taxi stand or a border area taxi waiting stand established on any right of way or other public property located within the following area: 

      1. on the west, the western edge of San Luis Plaza Drive;
      2. on the south, the border between the United States and Mexico;
      3. on the east, the eastern edge of Sixth Avenue and
      4. on the north, the east-west alignment along the northern edge of D Street to the alignment of the western edge of San Luis Plaza Drive.

Finally, any border area taxi vehicle permits paid for calendar year 2023 will be revoked and refunded.

If Ordinance No.437 is approved, we will refund the money for the border area taxi vehicle permits that had already been paid for calendar year 2023. Total refund amount will be $840.00 (35 permits at $24.00 per permit).
