Discussion and possible action on any and all matters regarding the contract with Century Link to provide fiber optic services at the Business Incubator over the next five (5) years. (Jenny Torres, Community Development Director)
SUMMARY:
Staff finalized negotiations with Century Link for the installation of fiber optic at the Business Incubator. Installation will be done with no special construction charges. The City will enter into a five (5) year contract for fiber optic services with a monthly recurring charge of $1,267.00.

- Under Section 36.01(A) of the San Luis Purchasing Code, the total for the contract is calculated either for the period of the contract or for one (1) year whichever is less. Here, one year is $1,267.00 times 12 months equals $15,204.00.
- Under Section 36.01(D) of the San Luis Purchasing Code, at amounts over $15,000.00, three (3) written quotes are required, but City Council's approval is not required. In this case there are only two (2) providers, Century Link and Time Warner Cable. Time Warner Cable informed staff via e-mail that they do not provide fiber optic services to this location.
- Under Section 36.01 (F) of the San Luis Purchasing Code, no service contract of $15,000 and above, or sealed bid or proposal above $35,000 or more, shall be let except by the Mayor and Council. The purchasing agent shall present the bids or proposals to the Mayor and Council for the approval.
- Under Section 36.02 of the San Luis Purchasing Code, where there is only one provider, the provisions in Section 36.01(D) for obtaining three written quotes is not required.
RECOMMENDATION / SUGGESTED MOTION:
I MOVE TO APPROVE THE CONTRACT WITH CENTURY LINK FOR FIBER OPTIC SERVICES AT THE BUSINESS INCUBATOR AS PRESENTED.
