Consider recommending approval of RFP-26-002 Professional Legal Services for Special PFAS Litigation Counsel to NM Local Government Law, LLC. (Hess Yntema)
BACKGROUND:
Initiated by: Hess Yntema
The City of Roswell issued RFP-26-002 seeking proposals from qualified law firms to provide professional legal services as Special PFAS Litigation Counsel. The selected firm will assist the City in pursuing legal remedies and recovering costs associated with PFAS an AFFF contamination affecting the City's drinking water and wastewater systems.
Three proposals were received and evaluated by the City's Evaluation Committee in accordance with the RFP criteria.
Final scores were as follows:
* NM Local Government Law, LLC — 87.12
* Nachawati Law Group — 78.67
* Stag Liuzza, LLC — 74.88
Based on qualifications, municipal experience, and understanding of PFAS litigation, the Evaluation Committee recommends award to NM Local Government Law, LLC as the most advantageous proposer for the City.

FINANCIAL CONSIDERATION:
There is no upfront financial cost to the City. Legal fees will be contingent upon successful recovery of funds through litigation or settlement. The firm will be compensated only if the City receives financial recovery.
LEGAL REVIEW:
Contracts will be reviewed by legal upon award.
BOARD AND COMMITTEE ACTION:
Legal Committee will be the first to consider this item.
