SUMMARY/BACKGROUND:
Amy S. Nations, Agent, filed an Owner Transfer application on behalf of Southern Bites, located at 2985 N. Centre Court, Suite B, Prescott Valley, Arizona 86314. The premises were previously occupied by Rafter Eleven (which held a Series 6 Bar Liquor License that has since been canceled).
Pursuant to ARS §4-203(C), a spirituous liquor license may be transferred to a person qualified to be a licensee if the transfer is pursuant to either judicial decree, nonjudicial foreclosure of a legal or equitable lien (including security interests held by financial institutions pursuant to §4-205.05, a sale of the license, a bona fide sale of the entire business and stock in trade, or other bona fide transactions that are provided for by rule.
ARS §4-201(G) generally places the burden on an applicant to demonstrate that public convenience requires the license and that issuance of the license will substantially serve the best interests of the community. However, the statute provides an exception for a person-to-person transfer of a transferable license that will be used at the same location (as otherwise provided by ARS §4-203(A)).
Following consideration of the application, the Town Council may forward a recommendation of approval or disapproval to the Arizona Department of Liquor License and Control for final action on the license.
