Discussion and possible action to enter into a Letter of Agreement, LOA, between Webb County and the Webb County Sheriff’s Office and the Webb County Deputy Sheriff’s Association clarifying Provision C in Appendix D of the Webb County Deputy Sheriff’s Association Collective Bargaining Agreement (CBA), and to further clarify that the Sheriff’s Command Staff positions listed on Appendix B of the CBA, which include Chief Deputy, Deputy Chief, and Commanders, and the Sheriff’s positions excluded from Civil Service by Rule which include Public Information Officer, Finance Director, and Administrative Manager are not subject to the posting procedures of the Webb County Human Resources Department.
 
Issue: Clarification is needed for Provision C of Appendix D (page 38) of the Collective Bargaining Agreement, which gives the Sheriff the authority to promote an officer with at least four (4) years of experience to Corporal provided that there is a vacant Corporal slot available. And further clarification is needed for Appendix B (p.35) of the Collective Bargaining Agreement and for the positions Excluded from Civil Service by Rule (Webb County Civil Service Commission, Attachment A) that allow the Sheriff to appoint his Command Staff.  
 
Solution: Enter into a Letter of Agreement (LOA) authorizing Webb County Human Resources Department to accept the appointments under Provision C of Appendix D of the CBA, the positions listed in Appendix B of the CBA and the positions Excluded from Civil Service by Rule to be excluded from the posting procedures listed by Webb County Human Resources Department and allow the Sheriff to appoint an officer at the Sheriff’s discretion for Corporal, as stated in the provisions of the Collective Bargaining Agreement and appoint his Command Staff.  
 
Result: The Sheriff will be able to exercise the contractual right given by the CBA and appoint positions that are appointable by statute, policy or contract.
