Discussion and possible action to approve the use of the contingency allowance as stipulated under §4.3 (allowances) under the construction agreement between Webb County and Mor-Wil, LLC., in an amount not to exceed $40,400.00 for Land Acquisition of a parcel of land consisting of a 1 acre tract for the La Presa Booster Station, for ARPA Project No. 0004, 0005, 0009, 0010, 0012 and 0013 – Waterline Projects and to further authorize the Webb County Judge to sign any relevant documents; and any other matters incident thereto. Issue: On May 26, 2026, Webb County Commissioners Court approved to assign current Contingency Funds that are budgeted within the project, and executed a contract to include the La Presa Booster Pump Station that will be required to provide adequate pressure and flow, improve system reliability, and support existing and future demand. ARDURRA Group has identified  A 1-Acre Tract called out of a larger 178.76 Acre tract identified in VOL. 5554, PG. 244 which is specifically located off Mangana Hein Rd and in the immediate alignment of the Waterline Extension Project.
 
Solution: ARDURRA Group has coordinated with the landowners of this tract and were given permission to survey the 1 Ac. tract in order to issue to Brighton Group and proceed with acquisition services for said tract. The landowner requested compensation due to the size of the tract and an appraisal was ordered and completed on May 18, 2026, by Appraisal Haus and issued to Webb County Engineering on May 20, 2026. The value identified in the formal appraisal is $40,400.00. At this time, consideration to authorize the use of $40,400.00 from the owner's contingency allowance funds is being requested.

Result: Commissioner Court approval will allow and accept Brighton Group to provide an official offer of the appraised value to the landowner for formal acquisition. In the interim, the landowners are willing and cooperative to issue a formal Right of Entry for the construction phase to assure the contractor can proceed with all scopes related to the Booster Station and the 1 Ac. tract so that this project can remain on schedule for completion by the end of 2026. If approved, the Contractor will be authorized to use the owner's contingency amount as approved.  There will be no increase or decrease to the original contract sum.
