Resolution for reallocating ARPA obligated project funds

Discussion and possible action to approve a resolution for reallocating of Webb County’s ARPA Obligated Project Funds from One Project to Another. Webb County has appropriated all its ARPA allocated funds to 40 adopted projects meeting all requirements set forth by the State and Local Fiscal Recovery Funds (SLFRF) program guidelines. US Treasury under SLFRF Guidelines FAQ 17.16 allows for the transfer of Obligated ARPA Funds from project to project. Webb County authorizes Brighton Group to follow all SLFRF procedures in reporting with the US Treasury.

Issue: Webb County currently has (4) ARPA Projects have been completed and closed with remaining ARPA Obligated Funds due to savings in scope and unused Owners Allowances assigned to the project by court action and executed contract. The projects are as follows: ARPA Project's - 0020 Rio Bravo North Ditch, 0022 - Records Preservation County Clerk, ARPA 0029 - El Pico Road & Drainage Project & ARPA 0026 - Southern Health Facility and identified in the attached "Exhibit A" with their respective amounts. 
 
Solution: Webb County authorizes the movement of ARPA surplus funds from Webb County ARPA projects listed above that are completed with savings from Obligated totals listed on executed contracts and reported to the US Treasury to be reassigned and obligated to ARPA Project 0004 Waterline Extension Project and ARPA 0018 ARPA Administration Services - ROW scope for parcels required for acquisition in the La Presa Subdivision related to Webb ARPA Project 0004 which meets the requirements set forth by the US Treasury SLFRF Guidelines.
 
Result: ARPA 0004 Waterline Extension Project will receive and obligate the additional Webb County ARPA funds needed to cover the remaining balance needed from the Executed Change Order #2 approved by Commissioners Court on May 26, 2026, as well as ARPA 0018 for the acquisition scope to the Booster Station parcel and additional parcel needs in the La Presa subdivision. This will support the extension of the waterline from the Booster Pump Station to the La Presa community by ensuring adequate conveyance capacity, maintaining system pressures, and providing reliable and sustainable water service.

Background:

Webb County has received $53,736,408 it was allocated from the US Treasury American Rescue Plan Act (ARPA) State and Local Fiscal Recovery Funds (SLFRF). Webb County has provided additional funding through grants and other sources of funding to fulfill the approved and adopted ARPA Projects that are eligible under the American Rescue Plan Act Funds and approved by Webb County Commissioners Court.
 
A total of 40 Projects were developed and confirm that all funds were obligated by the Deadline of December 31, 2024. To date 33 projects have been fully completed while all remaining projects are coming to a final closing no later than December 31, 2026.
 
SLFRF Guidelines for surplus of Obligated Funds to Existing Projects is authorized by FAQ 17.16:
 
a.) Recipient may use SLFRF funds to cover increased costs attributable to pre-existing obligations to accommodate the change or contingency prior to December 31, 2024
b.) Recipients may also cover contract cost increases after December 31, 2024, using SLFRF funds that the recipient does not use as initially reported to cover projects.
c.) Recipients may cover cost of amendments to contracts if the amended contract is within substantially the same scope and for substantially the same purpose as the contract incurred by December 31, 2024.
 
Exhibit “A” identifies projects requiring additional funding.
