Discuss, consider, and take appropriate action authorizing the filing of a Complaint for Declaratory Judgment and Injunctive Relief against the Department of the Interior (“Department”), the U.S. Fish and Wildlife Service (“Service”), and other necessary parties for violations of the Administrative Procedure Act and the Endangered Species Act (“ESA”) in connection with designation of critical habitat for ESA-listed species; specifically, the Department and the Service’s unlawful promulgation of the final rule designating critical habitat for the Georgetown salamander (Eurycea naufragia) and Salado salamander (Eurycea chisholmensis) in Williamson County, Texas.
