Discuss, consider and take appropriate action acknowledging the engagement of Michael Best & Friedrich LLP by the Williamson County Auditor, Julie Kiley, in her official capacity to represent the interest of the Williamson County Auditor relating to a dispute with the Williamson County District Attorney regarding the Williamson County Auditor’s authority to audit certain funds relating to the Williamson County District Attorney’s Office and other legal matters pursuant to the terms of the engagement agreement; discuss, consider and take action on authorizing the funding necessary for such legal services, and, to the extent necessary, exemption of such services from the competitive bid/proposal requirements of the County Purchasing Act pursuant to the discretionary exemption for personal or professional services, as set forth under Tex. Loc. Gov’t Code § 262.024(a)(4).

Public Background

Representation of the Williamson County Auditor, Julie Kiley, in her official capacity, in regard to a dispute with the Williamson County District Attorney regarding her authority to audit certain funds relating to the Wiliamson County District Attorney’s Office. Representation of the Williamson County Auditor may include other legal matters that may be assigned or requested by the Williamson County Auditor, only if the scope of which is confirmed by the Williamson County Auditor at the time of assignment and such services are approved by the Williamson County Commissioners Court or its General Counsel’s Office. Although the client would be the Williamson County Auditor, payment for the representation would be provided by Williamson County, Texas, acting by and through its Williamson County Commissioners Court, and the representation would be conducted in a manner consistent with Rule 1.06 (comment 12) and Rule 1.08(e) of the Texas Disciplinary Rules of Professional Conduct.
