Discuss, consider, and take appropriate action on exempting procurement of the American Heart Association (AHA) training materials list for Williamson County EMS and any related services from the competitive bidding requirements pursuant to Texas Local Government Code Discretionary Exemption 262.024(7)(A) [items for which competition is precluded because of existence of patents, copyrights, secret processes, or monopolies].
Background
Williamson County EMS utilizes CPR and First Aid materials and training documents from the American Heart Association (AHA). As an American Heart Association Training Center, Williamson County EMS is required to issue AHA Course Completion Cards (eCards) to every student that successfully completes the class. AHA alone is authorized to sell their course completion cards. EMS is requesting the exemption be granted, as the training materials are copyrighted. The Purchasing Department agrees with this exemption request. The exemption will satisfy the 3-quote requirement for purchases of over $5,000.00 in our purchasing policy and will be valid for thirty-six (36) months from approval date. Historically, the purchases have not met the bid-limit threshold of $50,000.00. FY20: $24,057.86, FY21: $12,152.36, FY22: $8,984.96, FY23: $8,879.89 (another $8,110.17 will be added this FY23- quote attached). The funding source is 01.0100.0540.003101.
