Discuss, consider, and take appropriate action to convert PCN2003.001100 from a grant position to a permanent position due to vacancy.
Background
In 2021, the District Attorney, with approval of the Commissioners Court by Resolution, first applied for a grant to partially fund a position to prosecute felony adult sexual assault cases. The District Attorney received the grant, and the Adult Sexual Assault Prosecutor began work in FY2022.
The Adult Sexual Assault Prosecutor allowed the District Attorney to establish a Special Victims Unit (SVU) to handle special victim crimes including physical and sexual abuse of children, adult sexual assault (intimate partner) and family violence. The District Attorney SVU includes seven positions including five Prosecutors, an Investigator, and a Victim Assistance Coordinator.
The District Attorney received the grant again in FY2023. On October 30, 2023, the District Attorney was notified that the grant amount of $57,401.61 was awarded for FY2024, the final year of eligibility.
The Adult Sexual Assault Prosecutor assigned to the grant position has resigned to work in private practice. The District Attorney requests that the grant position be converted to a permanent position so that the term of employment offered is not limited to nine-months.
The County is already funding $115,808.43 (68%) of the position through September 2024. There are two options for conversion:
The District Attorney must fill the vacancy to fulfill the requirements of the grant. If the grant position is not converted to a permanent position, immediately or effective September 1, 2024, it will not be feasible for the District Attorney to fill the position for only a nine-month employment term.

- Convert the position immediately, return the grant funds, and the District Attorney will fill the position on or after a date when the current general fund budget covers funding the position for FY2024; or
- Convert the position effective September 1, 2024 and accept the grant funds.
The District Attorney must fill the vacancy to fulfill the requirements of the grant. If the grant position is not converted to a permanent position, immediately or effective September 1, 2024, it will not be feasible for the District Attorney to fill the position for only a nine-month employment term.
