Discuss, consider and take appropriate action on approving a Hardware Maintenance and Software License, Maintenance and Support Services Agreement #2025363 between Williamson County and Election Systems and Software, LLC (ESS) for the period of August 1, 2025, through July 31, 2026, for the new Warranty, License Fees and Firmware License in the amount of $155,772.74 and exempting the purchase from competitive requirements per Texas Local Government Code §262.024(a)(7)(D)[captive replacement parts or components for equipment].
Background
Approval of this Agreement with Election Systems & Software, LLC for the new Warranty, License Fees and Firmware License due to having to replace existing Ballot Marking Device voting equipment with Ballot on Demand equipment. The recent Executive Order stated that ballots could not be marked with barcodes. The funding source is 01.0100.0492.004506 for FY26. Origination #3562.
