Discuss, consider, and take any appropriate action for adoption and implementation of policies, guidelines, and procedures for the Williamson County Facilities and the Road & Bridge Departments regarding project and roadwork signs to limit such signage to informing the public of the precinct number and relevant information such as funding sources or other governmental entities involved in project(s) without naming specific local elected officials in order to meet legal compliance with Tex. Elec. Code Section 255.003, which prohibits the use of public funds for any political advertising or promotion. Proposed policy would exempt small signs for office suites and building historical markers giving information on the commissioners court administration that completed the building project.

Background

The Texas Ethics Commission has interpreted the prohibition on “political advertising” very broadly. Ethics Advisory Opinion No. 443 (2002) (EAO 443). Thus, it is recommended that the commissioners court adopt a policy banning the mention of any specific local elected officials (not just commissioners) on all facility and road work project signs. However, the proposed policy specifically exempts signage for suite numbers and historical markers giving information on the commissioners court administration that completed the building project if such historical marker lists the names of all members of the Court.
