Recommended Action
Authorize the Yolo County Procurement Manager or designee to execute any financial amendments necessary to extend current agreements with California Forensic Medical Group, to be approved as to form by County Counsel, for the provision of comprehensive medical services and professional behavioral health services to the detainees of the Yolo County as follows:
- Authorize the Yolo County Procurement Manager or designee to extend the term of Agreement No. 16-194 with California Forensic Medical Group through October 31, 2023 and add funding in the amount of $377,687.65 for the provision of comprehensive medical services to Yolo County detainees.
- Authorize the Yolo County Procurement Manager or designee to extend the term of Agreement No. 16-195 with California Forensic Medical Group through October 31, 2023 and add funding in the amount of $82,363.14 for the provision of professional behavioral health services to Yolo County detainees.
- Authorize the Yolo County Procurement Manager or designee to execute monthly financial amendments necessary to extend Agreement No. 16-194 with California Forensic Medical Group and increase funding in a monthly amount not to exceed $299,352.45 for the provision of comprehensive medical services to Yolo County detainees.
- Authorize the Yolo County Procurement Manager or designee to execute monthly financial amendments necessary to extend Agreement No. 16-195 with California Forensic Medical Group and increase funding in a monthly amount not to exceed $65,280.44, for the provision of professional behavioral health services to Yolo County detainees.

Reason for Recommended Action/Background
As explained in more detail below, Health and Human Services Agency (HHSA) and other County departments are currently negotiating new long-term agreements with CFMG for medical, behavioral health, and related services in Yolo County detention facilities. The agreements are complex and require careful consideration of the range of services to be provided, appropriate staffing levels, and related costs. The team of County staff negotiating on behalf of the County is working diligently to present long-term agreements for Board consideration as soon as possible, but it is presently necessary to extend the existing contracts with CFMG during the negotiating period to reduce the risk of a contract lapse, ensure continued compliance with federal and state regulations, and avoid any interruption in services to detainees.
Approval of the recommended actions will enable the negotiating team to conclude short-term amendments in a form acceptable to the County Counsel. Without any extension, the current agreements will expire on September 30, 2023.
Medical Services - Agreement No. 16-194
Yolo County is mandated to provide effective and quality comprehensive medical services to detainees of the Yolo County Jail and Juvenile Detention Facility (Yolo Jail Facilities). On or about December 3, 2015, HHSA in collaboration with the County Administrator's Office (CAO), the County Probation Department (Probation) and the Sheriff's Office (Sheriff), issued a request for proposal soliciting a provider of comprehensive medical services for the detainees in the Yolo Jail Facilities (“2015 Jail Medical RFP”). Ultimately, the resulting agreement was awarded to California Forensic Medical Group, Inc. (CFMG) and thus on or about November 22, 2016, the County and CFMG entered into Agreement No. 16-194 (“Medical Services - Agreement No. 16-194”) for the provision of comprehensive medical services at the Yolo Jail Facilities, effective December 1, 2016.
On or about April 12, 2022, the County and CFMG amended the Agreement to add Medication Assisted Treatment (MAT) Services. MAT services include the use of FDA-approved medications, in combination with counseling and behavioral therapies, to treat substance use disorders as a medical disorder. The MAT program provides addiction treatment and recovery within correctional facilities. MAT also provides opioid addiction and other substance use disorders in more than 70 correctional facilities.
A formal solicitation via a request for proposal was issue by the County in March 2023 (“March 2023 RFP”) for a new agreement for these services. CFMG was the only respondent and March 2023 RFP Review Committee determined CFMG met the minimum qualifications of the March 2023 RFP. The extension contemplated herein will allow time for the final contract negotiations with CFMG for the new agreement to be awarded under the March 2023 RFP, with a targeted start date of November 1, 2023. In August 2023, this Board approved amendments to Medical Services - Agreement No. 16-194 to extend it through September 30, 2023 and to add requisite funding for the extension period with a goal of having new agreements as a result of the March 2023 RFP in place for an October 1, 2023 start.
Negotiations are ongoing and now HHSA in collaboration with the CAO, Probation, and Sheriff requests authority to extend the Medical Services - Agreement No. 16-194 for an additional month through October 31, 2023 and to add funding in an amount not to exceed $377,687.65 for the extension period with delegated signing authority to the Yolo County Procurement Manager or designee to assist with expediting execution of the extension to reduce the risk of a contract lapse and ensure continued compliance with federal and state regulations. Due to the complexity of the services and negotiations, HHSA, CAO, Probation, and Sheriff are also requesting delegated authority to the Yolo County Procurement Manager or designee to execute additional monthly extensions to the Medical Services - Agreement No. 16-194 in a monthly amount not to exceed $299,352.45, if needed to prevent a contract lapse, ensure continued compliance with federal and state regulations, and avoid any interruption in services to detainees while the new agreement is finalized and executed.
HHSA, CAO, Probation, and Sheriff believes it is the best interest of the County to extend Medical Services - Agreement No. 16-194 based on satisfactory service and to avoid the interruption of County business.
Behavioral Health Services - Agreement No. 16-195

Thus, pursuant to the authority provided to the Yolo County Procurement Manger as the Yolo County Purchasing Agent under the current Yolo County Procurement Policy, the Procurement Manger has determined that it is in the best interest of the County to extend this Agreement, based on satisfactory service and to avoid the interruption of County business. A formal solicitation for these services was released March 2023. From the solicitation CFMG was the awarded contractor. Currently, the County is in final contract negotiations with CFMG for new targeted start date of November 1, 20233.

These services will be funded by County General Funds and MAT funding. The action increases the contract maximum by $377,687.65, for a new contract maximum of $24,702,555.91, for the period of December 1, 2016 through October 31, 2023. The amount of $377,687.65 is included in the HHSA adopted budget for fiscal year 2023-24.
This action also allows for monthly increases to this agreement at $299,352.45 per month beyond October 31, 2023 until the new agreement is negotiated and executed. The increases of $299,352.45 per month are also included in the HHSA adopted budget for fiscal year 2023-24.
