Recommended Action

Delegate signing authority to the Yolo County Procurement manager to execute the fourth amendment to Agreement No. 21-193 with the City of West Sacramento to add funding in the amount of $105,598 for a new contract maximum of $501,598, for the period of December 22, 2020 through September 30, 2023, for the provision of Emergency Shelter Operations as a subrecipient of the Emergency Solutions Grant-Coronavirus Round 2.

Reason for Recommended Action/Background

On or about June 1, 2020 the California Department of Housing and Community Development (HCD) released a Notice of funding Availability (NOFA) for the Federal Emergency Solutions Grant Program Coronavirus (ESG-CV). The funding was allocated to the Homeless and Poverty Action Coalition (HPAC) for the purpose of preventing, preparing for, and responding to coronavirus. On or about June 24, 2020, HPAC voted to make Yolo County the administrative entity for the ESG-CV funds. On or about December 22, 2020, the County entered into State Agreement No. 20-ESGCV1-0035 (“State Contract”) with the Department of Housing and Community Development (“Department”), via the Department’s administration of the Federal CARES Act Emergency Solutions Grants (“ESG-CV”) Program, pursuant to the provisions of the 2020 Federally enacted Coronavirus Aid, Relief, and Economic Security Act, Title XII, Homeless Assistance Grants Section (“CARES Act”) and any waivers including the HUD Mega-Waiver dated April 1, 2020,  and where not superseded by the CARES Act, pursuant to the provisions of 42 USC 11371; 42 USC 11378; 24 CFR Part 576; all as shall be amended from time to time.

On or about June 9, 2021 Department of Housing and Community Development amended the State Contract to add ESG-CV Round 2 funding.
On or about August 31, 2021, County entered into an Agreement with City of West Sacramento for the provision of Emergency Shelter operations with ESG-CV Round 2 initial funding of $396,000 and an initial term of December 22, 2020 through September 30, 2022.

On or about November 1, 2022, the agreement was amended to extend the term through September 30, 2023 with no revision to the funding amount.

Approval of this amendment will allow for additional funding but will not extend the term of the Agreement. The agreement expired on September 30, 2023. Approval of this amendment is needed to expend all funds that were received by the ESG-CV grant. Another contractor was not able to expend all their funds and we received approval from HCD (funder of grant) to move funds to this grant to ensure we expended all funds allocated to Yolo County through the ESG-CV grant.

Approval of the request herein will enable HHSA to meet the extended expend by deadline set by HCD. This amendment is currently with City of West Sacramento for their review and signature. Once HHSA has obtained their approval and signature, the agreement will be routed to the Procurement Manager for the final County signature.

Competitive Bid Process/Vendor Performance

ESG CV Round 2 funding was a local selection process held by non-conflicted members of HPAC that reviewed and scored each proposal, made a recommendation to the HPAC Board, and as a result of the PAC Board votes this proposal was selected.

No general funds are required by this action. These services will be funded by Housing and Community Development ESG-CV Round2. The total amount of this action is $105,598 for the period of December 22, 2020 through September 30, 2023. The amount of $105,598 is included in the HHSA adopted budget for FY23-24.
