Adopt Resolution of Acceptance of Parcel Map No. 5219 for a ministerial (non-discretionary) urban lot split an approximately 0.12-acre parcel into two equal 0.057-acre lots in the community of Esparto as authorized under the Yolo County Code (Section 8-1.302(b)) and Subdivision Map Act (Government Code Section 66411.7); determine the action is exempt under the California Environmental Quality Act (CEQA). (No general fund impact) (Lindbo/Trebec)
Recommended Action
- Determine the project is statutorily exempt from the California Environmental Quality Act in accordance with CEQA Guidelines Section 15268, which exempts ministerial projects from the requirements of CEQA;
- Adopt the Resolution of Acceptance of Parcel Map No. 5219 (Attachment C);
- Instruct the Clerk of Board of Supervisors to verify that the Tax Collector has signed the map; and
- Authorize the Clerk of the Board of Supervisors to sign and transmit Parcel Map No. 5219 (Attachment D) to the County Clerk-Recorder for filing.

Reason for Recommended Action/Background
On February 8, 2022, the Board of Supervisors adopted a zoning code amendment to include, among other things, the addition of non-discretionary urban lot splits to the County Code. Per Yolo County Code Section 8-1.302(b), which was adopted to comply with Government Code Section 66411.7, a parcel map may be approved ministerially (i.e. based on objective criteria without the exercise of discretion) when the following requirements are met: The parcel is within an area zoned R-L or R-M and defined by the United States Census Bureau as urbanized or an urban cluster; no more than two parcels of approximately equal area are created, and the applicant signs an affidavit that the applicant intends to occupy a home on one of the resulting parcels as a primary residence for at least three years. The urban parcel split does not require a tentative parcel map.
The proposed Project is the first urban lot split application the County has received since the implementation of the code amendment in March 2022. The Project site is designated as Residential Medium (RM) by the 2030 Countywide General Plan and zoned Medium Density Residential (R-M) on the County Zoning Map. It is located within the census block that contains Esparto and Madison and is defined by the US Census Bureau as an urban cluster. The proposed lot split would divide the parcel into two equal lots of 0.057 acres each, and, as required by state law, the owner has signed an affidavit stating his intention to establish his primary residence on the parcel for at least three years. The Project is consistent with policies in the 2030 Countywide General Plan that aim to encourage a mix of housing types, densities, affordability levels, and designs and is also consistent with zoning standards for meeting lot size requirements in the R-M Zone (County Code Section 8-2.505). The Applicant has satisfied all requirements for an Urban Lot Split per Yolo County Code Section 8-1.302(b) and has submitted the final Parcel Map for acceptance by the Board of Supervisors.
The Parcel Map was deemed technically correct by the County Surveyor on August 16, 2023. Staff supports the approval of the Project because the Parcel Map conforms to all the requirements of the State Subdivision Map Act and all provisions of applicable County ordinances as well as satisfying the intent and policies of the 2030 Countywide General Plan Housing Element.
Pursuant to Section 15268 of the California Environmental Quality Act (CEQ) Guidelines, the approval of a Parcel Map is exempt from the requirements of CEQA as a ministerial project.
