Recommended Action
Approve fourth amendment to Agreement No. 19-253 with Luhdorff & Scalmanini Consulting Engineers, Inc. for the engineering and design of the arsenic treatment facility at the Wild Wings County Service Area to extend the term for one additional year through June 30, 2025.

Reason for Recommended Action/Background
In October 2019, the Wild Wings County Service Area (CSA) issued a request for proposals (RFP) for an arsenic treatment project to reduce arsenic levels in both Wild Wings wells (Canvasback and Pintail). On or about December 17, 2019, the County entered into an agreement with Luhdorff & Scalmanini Consulting Engineers (LSCE) to oversee the arsenic treatment system project (Attachment A). In 2021, LSCE analyzed water demands and put forth conceptual treatment options. An amendment was entered to conduct pilot testing of the conceptual treatment options. In June 2021, the Canvasback well had to be taken completely offline due to diminished water levels, and the arsenic project was put on hold.
In May 2022, the Board of Supervisors approved an amendment to extend the term of the LSCE agreement for an additional year through June 30, 2023. In 2023, LSCE drafted the plans and specifications for construction of the arsenic project. The arsenic project then went out to bid and construction began after the bid was awarded. The estimated completion date for the arsenic project is Spring 2025. Additional engineering oversight from LSCE is required to ensure the construction contractor builds the arsenic facility according to plan. The current contract term expired on June 30, 2024. The proposed fourth amendment to Agreement No. 19-253 (Attachment B) will extend the term of the Agreement with LSCE for one additional year, through June 30, 2025, to allow construction engineering oversight by LSCE through project completion. There is no additional expense associated with this action, as the contract has available unused funding which has been incorporated into the FY 2024-2025 budget for the Wild Wings Water Fund and adopted by the Board of Supervisors as part of the annual budget approval process.
