Reason for Recommended Action/Background

The Yolo County Board of Supervisors introduced the proposed Ordinance (Att. A) on July 8, 2025, and continued the item to July 22, 2025 for second reading and adoption.

Background
The Underground Storage of Hazardous Substances Ordinance was originally adopted into the Yolo County Code in 1984 to set standards for the construction, monitoring, and permitting of facilities used for the underground storage of hazardous substances. The ordinance was last updated in 1989. Since then, both state statutes and regulations have evolved, rendering the Yolo County ordinance outdated and inconsistent with current state requirements outlined in the California Health & Safety Code, Chapter 6.7, and the California Code of Regulations, Title 23, Chapter 16.

The Underground Storage Tank program is administered by the County Division of Environmental Health. Environmental Health staff reference and utilize the State statutes and regulations when performing inspections and conducting enforcement, thereby rendering the Yolo County Code unnecessary and potentially duplicative. In light of this, staff recommend repealing Chapter 11, Title 6 of the Yolo County Code.
