Reason for Recommended Action/Background

Over the past several years, there has been a steady increase in the amount of felony incompetent to stand trial clients being referred to the Department of State Hospital for competency restoration without adequate capacity in the existing State Hospitals.  This has led to a significant backlog of clients throughout the State waiting in jails for months at a time until placement can be made at a State Hospital bed.  As a result, the Department of State Hospitals has been working with the State and various counties to increase statewide capacity for local treatment options.  These options include Jail Based Competency Treatment programs.  Yolo County entered into an agreement with the State of California, Department of State Hospitals (“DSH”), State Agreement Number 22-79013-000 (“Yolo/DSH Agreement”), for administration of a Jail Based Competency Treatment (“JBCT”) program. The Yolo/DSH Agreement will expire on December 31, 2025. The County is working with DSH to enter into a renewal agreement effective January 1, 2026 to allow services to continue for the JBCT program for restoration of competency to certain felony patient inmates deemed Incompetent to Stand Trial (“IST”) under Penal Code section 1370 to occur locally in the jail rather than in a State Hospital for those determined to be appropriate. 

The Yolo/DSH Agreement will provide funding for a dedicated Correctional Officer (CO) assigned to the JBCT program.  This is a critical component to a JBCT program as there are often individuals receiving JBCT services that have different classifications, require supportive oversight, and having a dedicated CO that receives specific training as part of the overall JBCT team increases effectiveness of the program.  The Yolo/DSH agreement will also provide the Sheriff Department with funding for the overall housing costs associated with five (5) dedicated beds and two (2) additional beds at the Monroe Facility.

HHSA is requesting approval and delegated signing authority to the Chair to expedite the execution of the new County and Recovery Solutions (RS) Agreement. RS is a qualified inmate medical services provider that provides services to assist the County with its JBCT program. RS will provide services to five (5) dedicated beds and two (2) additional beds at the Monroe Facility. The services shall be provided 24 hours per day, seven days per week, including all state holidays.

Competitive Bid Process/Vendor Performance

On November 20, 2025, the County’s Deputy Director of GSD/Manager of Procurement/County Purchasing Agent (Purchasing Agent) approved a sole/single source procurement for these services. Without sole/single source approval for these services, the County would be negatively impacted including: the JBCT program and our agreement with DSH; loss of compliance with State Law and DSH contractual requirements; increased jail population and extended incarceration of IST defendants; risk of court orders and legal penalties; loss of DSH funding and reimbursement; and disruption of clinical care and increased safety risks and reduction of services for mentally ill inmates.  Other counties use their own staff who require a high level of forensic expertise or their own psychiatric staff, but the County does not have that capacity or staffing. The County would face significant delays due to staff onboarding, jail clearance, training and DSH approval. It would also negatively impact the DSH growth cap, resulting in the county owing more money for the number of IST individuals over the baseline number.

No general funds are required for this action. These services will be funded by Department of State Hospitals. The total amount of this action is $4,457,531.58 for the period of January 1, 2026 through December 31, 2028. The amount of $742,921.93 will be included in HHSA requested mid-year budget for fiscal year 2025-26. The related funding will be included in the requested budget process for future fiscal years.
