Reason for Recommended Action/Background
Mr. Pogledich was initially appointed County Counsel effective August 30, 2014 for a term of four years, as specified in California law. The Board subsequently reappointed Mr. Pogledich to additional four-year terms effective August 30, 2018 and August 30, 2022. At the time of Mr. Pogledich’s reappointment in 2018, the Board also approved a First Amendment to his Employment Agreement. For reference purposes, the Employment Agreement and the First Amendment thereto are included herewith as Attachments B-C.
Based on its continued evaluation of his work, the Board of Supervisors would like to reappoint Mr. Pogledich to a fourth term as County Counsel. Like his prior terms and as required by California law, his fourth term will have a four-year duration, and it will extend through August 29, 2030. Also, the current compensation (as of December 2025) for the position of County Counsel is 9.76% below the market median in the eight comparable counties customarily used for County compensation surveys. In alignment with county practice of providing compensation at 100% of market comparison, the Board would therefore like to provide phased compensation adjustments to Mr. Pogledich, as follows:

- Effective the pay period that includes January 1, 2026, a six percent equity adjustment; and
- Effective the pay period that includes January 1, 2027, a 3.76 percent equity adjustment.
Historically, County Counsel has not been included in cost-of-living adjustments provided to all other county employees. Consistent with past practice, Mr. Pogledich will not receive any cost-of-living adjustments provided to other department heads through December 31, 2027, and thereafter will receive cost-of-living adjustments only if specifically approved by the Board.
The attached Second Amendment to Mr. Pogledich’s Employment Agreement reflects the proposed actions set forth above, including his reappointment and the compensation adjustments.
