Reason for Recommended Action/Background

Tobacco Prevention Program staff recommend that the Board of Supervisors introduce and receive the second reading of a proposed smoke-free multi-unit housing ordinance. This ordinance is designed to reduce exposure to secondhand smoke and improve health outcomes for residents living in multi-unit housing.
 
On February 10, 2026, staff presented an overview of this policy to the Board, including the public health rationale, local data on secondhand smoke exposure, policy options, and potential benefits for residents, property owners, and the broader community. On May 5, 2026, the Board received the proposed ordinance for its first reading and voted to move forward for a second reading.
 
The proposed ordinance will apply exclusively to the unincorporated areas of Yolo County and will encompass nine (9) residential complexes (apartments), totaling approximately 259 units. The ordinance aims to protect residents from involuntary exposure to secondhand smoke, which can infiltrate units through shared walls, ventilation systems, windows, and doorways.
 
Educational outreach for both the public and property owners will be conducted by the Yolo County Tobacco Prevention Program using funds from Proposition 56 and Proposition 99. As a result, implementation of this ordinance will not have a fiscal impact on the County’s General Fund. Staff will provide guidance to property owners on equitable enforcement practices and will offer cessation resources to residents.
 
Consistent with best practices from other jurisdictions, enforcement will focus on education and progressive compliance. Initial violations will result in verbal and written warnings, with a minimum of three written warnings issued prior to any further enforcement action. Each warning will include educational materials and information on available cessation services. Enforcement provisions may be refined at the discretion of the Board.
