Introduce by title only, waive first reading, and receive public comment regarding an ordinance entitled: "An Ordinance of the Board of Supervisors of the County of Yolo Amending Chapter 15 of Title 6 of the Yolo County Code Regarding Tobacco Retailer Permitting," and also receive feedback from the Board on policy considerations for a smokefree multi-unit housing ordinance  (No general fund impact) (Sullivan/Jensen)

Recommended Action

Introduce by title only, waive first reading, and receive public comment regarding amending the County's Tobacco Retail Licensing Ordinance to update the definitions of "Electronic Smoking Device" and "Smoking," clarify "Flavored Tobacco Product," add Tobacco Product Pricing and Packaging requirements and include HHSA Tobacco Prevention Staff for enforcement of the Ordinance.

Provide feedback to the HHSA Tobacco Prevention and Control Team on policy options for a County smokefree multi-unit housing ordinance.

Reason for Recommended Action/Background

Ordinance Amending Tobacco Retailer Permitting
The purpose of these amendments to the County's existing tobacco retailer permitting ordinance are to promote public health and provide regulatory protection for the County’s youth from harmful tobacco and nicotine products. These changes include adding a new Section 6-15.10 to establish regulations regarding package size and the price of tobacco products.  Similar regulations have been shown to effectively decrease the accessibility of these products to young individuals. Additional amendments to Title 6 of Chapter 15 include updating definitions to those currently commonly used, adding HHSA Tobacco Prevention Staff as compliance monitors, encouraging responsible tobacco retailing and ensuring that businesses may be held accountable for the selling and distribution of harmful and addictive tobacco and nicotine products to underage individuals. This Ordinance continues to be intended as a supplement to relevant provisions of Federal, State, and local law.

Smokefree Multi-Unit Housing Policy Options
In order to develop a county smokefree multi-unit housing ordinance, the HHSA Tobacco team needs guidance from the Board regarding specific policy considerations to include in the ordinance. Staff will present policy options to the Board and will use feedback provided to craft an ordinance to be brought to the Board for consideration at a future date.
