Recommended Action

  1. Approve agreement with Ameresco, Inc., with a maximum compensation of $1,775,000 and a term up to 5 years, to provide continuing management of the County's landfill gas-to-energy facility; and
     
  2. Authorize the Chair of the Board of Supervisors to sign the agreement.

Reason for Recommended Action/Background

The County owns and operates a landfill gas-to-energy facility at the Yolo County Central Landfill.  The facility has been in operation since the late 1980’s when it was originally developed by a private energy firm. In February 2016, the County purchased the landfill gas-to-energy facility from NEO Yolo LLC and MM Yolo LLC.  The facility consists of five engine/generators and produces up to 3 megawatts of electricity.

Since the County purchased the facility, the day-to-day management and operation has been contracted to a firm specialized in management of these types of facilities.  The current agreement is with Ameresco, Inc. and will expire June 30, 2023.

With the current agreement set to expire, Division of Integrated Waste Management (DIWM) staff circulated a Request for Proposals (RFP) on December 1, 2022 for management and operation of the facility. The County received only one proposal (Ameresco). After careful review of the proposal as well as review of Ameresco's past work and safety record (which has been very good) at the landfill gas-to-energy facility, staff recommends that the Board of Supervisors approve this new agreement with Ameresco, Inc. to continue their operation of the facility. The new agreement has a base term of three (3) years and can be renewed in June 2026 for an additional two years at the discretion of the DIWM Director.

The maximum compensation under this agreement is $1,775,000 during the entire term of the agreement and is composed of two parts: basic services and certain additional services at the request of the County.  Basic services include on-site staffing of the plant five days per week as well as management oversight.  The first year of basic services is estimated at approximately $207,000 and will escalate annually with inflation.  Additional services may include items related to inspection, maintenance and repair of plant facilities such as blowers, motors, radiators and electrical systems and is estimated at $130,000 annually.  The maximum compensation may only be increased above $1,775,000 with the approval of the Board of Supervisors.

The divisions proposed FY 23-24 budget includes $307,000 for this agreement ($207,000 for basic services and $100,000 for additional services). Future division budgets will include sufficient funds for management of the landfill gas-to-energy facility under this agreement. Revenue from the sale of electricity funds this agreement.
