Reason for Recommended Action/Background

The Clarksburg Lighting Assessment District was established in August 1982 under the Landscape and Lighting Act of 1972, with the adoption of Resolution 82-108.  The Assessment District is responsible for providing street lighting for the community of Clarksburg.   The streetlights are operated and maintained by Pacific Gas and Electric Company (PG&E) and the streetlight service provided within the District for the benefit of the District’s property owners is funded from an annual assessment of $35 per parcel, approved on November 23, 2021, following an assessment ballot proceeding (Resolution No. 21-151).  This was the first increase to the assessment since June 21, 1994.  Approval of the increase also included authorization for an annual CPI adjustment, rounded to the nearest dollar, with a cap of 5 percent.  The Landscaping and Lighting Act of 1972 requires than an annual Engineer’s Report be prepared by a licensed professional engineer and established other requirements for the continuation of the assessments. Yolo County Public Works prepared an Engineer's Report for the fiscal year 2023-2024 (Attachment B. Engineer's Report). The Engineer's Report includes the proposed budget for the assessments for fiscal year 2023-2024. 

On May 9, 2023, the Board of Supervisors adopted Resolution No. 23-69, which preliminarily approved the Engineer’s Report and set the date of the public hearing.  Notice of the public hearing was published in accordance with the Landscape and Lighting Act.

Proposed assessment rates for the fiscal year 2023-2024, as determined and described in the Engineer's Report is $37.00 per parcel.  A summary of the previous years' assessment rates and the proposed 2023-2024 rate is provided in the table below:

Approval of the resolution will result in the continuation of the levy assessments for fiscal year 2023-24 and will cause these levies to be submitted to the County Auditor to be included on the 2023-24 property tax bill. This public hearing will allow all interested persons the opportunity to participate in this decision-making process and will allow the Board of Supervisors to consider all oral statements and all written protests made or filed by any interested person.
