Recommended Action
Approve third amendment to Agreement No. 21-23 with MBK Engineers to extend the contract term by three years to June 30, 2026; modify the scope of work to reallocate funding between tasks and update sub-subconsultants; and make other administrative updates project management services for the Knights Landing Flood Risk Reduction Project.

Reason for Recommended Action/Background
Agreement No. 21-23
On January 26, 2021, the Board of Supervisors approved a three-year agreement with MBK Engineers in the amount of $13,178,593 to provide design, engineering, environmental compliance, regulatory permitting, and project management services for the Knights Landing Flood Risk Reduction Project for a period of January 1, 2021, through June 30, 2023 (Minute Order No. 21-09).
First Amendment
On February, 28, 2022, a First Amendment was executed to modify the scope of work to add a new Task 7 (Construction Management) and reallocate funding from Task 2 (Design Plans, Specifications, and Estimates) to the newly created Task 7. This reallocation did not result in an increase to the agreement's maximum compensation amount.
Second Amendment
On October 19, 2022, a Second Amendment was executed to reallocate funding between multiple tasks to align the respective task budgets with anticipated project expenses. This reallocation did not result in an increase to the agreement's maximum compensation amount.
Proposed Third Amendment
At this time, Staff is recommending the Board of Supervisors approve a Third Amendment to Agreement No. 21-23 (Att. A.).
The proposed Third Amendment will:

The proposed Third Amendment will:
- Reallocate funding between tasks to further align the respective task budgets with current and anticipated project expenses; and
- Extend the term of the agreement by three years to June 30, 2026, consistent with the extended term of the County's Department of Water Resources Small Communities Flood Risk Reduction Funding Agreement; and
- Update the insurance requirements for the contract; and
- Update the contact information for the Contractor and County; and
- Revise Exhibit A-2: Scope of Work to update the budgets for each task and project sub-subconsultants.

This agreement is being funded by a Funding Agreement with the California Department of Water Resources' Small Communities Flood Risk Reduction Program. The County's local match is being provided by the Knights Landing Levee Capital Project fund.
