Subject

Approve and authorize the Chair to sign State Agreement No. 23-79032-000 with California Department of State Hospitals in the amount of $500,000 for the period of July 1, 2023 through June 30, 2028 for the provision of Felony Incompetent to Stand Trial workgroup. (No general fund impact) (Sullivan)

Recommended Action

  1. Approve and authorize the Chair to sign State Agreement No. 23-79032-000 with California Department of State Hospitals (DSH) in the amount of $500,000 for the period of July 1, 2023 through June 30, 2028 for the provision of Felony Incompetent to Stand Trail workgroup; 
     
  2. Approve and authorize the Chair to sign Att. B. Contractor Certification Clauses and Att. C. California Civil Rights Laws forms; 
     
  3. Authorize the Yolo County Procurement Manager, or designee, to execute any non-financial extensions or amendments of the Agreement upon approval as to form by County Counsel; and
     
  4. Authorize the Director of Health and Human Services Agency, or designee, to execute any fiscal and program forms and reports required under this Agreement, including forms and reports required under any extensions or amendments thereto.

Reason for Recommended Action/Background

Entering this agreement will enable Health and Human Services Agency (HHSA) to coordinate, participate in, and facilitate a collaborative community stakeholder workgroup, which will include representatives from the District Attorney’s Office, Superior Court, Public Defender’s Office, Sheriff’s Office, Behavioral Health, Probation and local law enforcement. This workgroup will focus on developing and implementing local solutions that target the reduction of the number of individuals with serious mental illness arrested and incarcerated for behavior connected to their illness. This can include, but not limited to, planning for CARE Court, coordinating treatment, discussing housing options, planning for rearrest and/or reentry in diversion programs. The workgroup shall also focus on targeting the reduction of Felony Incompetent to Stand Trial (FIST) commitments overall within the County.

This is a revenue agreement therefore this agreement does not contain County performance measures.

No general funds are required by this action. The total amount of this action is up to $500,000 in revenue for the period of July 1, 2023 through June 30, 2028. The amount of $100,000 is included in the HHSA recommended budget for 2023-24. The related funding will be included in the requested budget process for future fiscal years.
