Subject

Adopt Plans and Specifications for the Construction of 2023 Groundwater Extraction Wells at the Landfill (Project); authorize the Director of the Division of Integrated Waste Management to sign the Notice to Contractors, advertise for competitive bids, award a construction contract to the lowest responsive and responsible bidder or reject all bids, and approve change orders up to the maximum allowable under State law, provided the total construction contract amount does not exceed available funds for the Project; and adopt a budget resolution increasing the Department of Community Services, Integrated Waste Management Division Budget by $600,000 (for a total appropriation of $33,295,666) to fund the Project. Recommended Action

  1. Adopt the plans and specifications for the Construction of 2023 Groundwater Extraction Wells (Project) (Attachments A and B);
     
  2. Authorize the Director, Division of Integrated Waste Management to sign the Notice to Contractors;
     
  3. Authorize the Division of Integrated Waste Management to advertise for competitive bids (Attachment C);
     
  4. Authorize the Director, Division of Integrated Waste Management to execute a construction contract with the lowest responsive and responsible bidder, provided the contract amount does not exceed available funds, or to reject all bids; 
     
  5. Authorize the Director, Division of Integrated Waste Management to approve all construction change orders up to the maximum allowable under State law, provided the contract amount does not exceed available funds for the project; and
     
  6. Adopt a budget resolution increasing the Department of Community Services, Integrated Waste Management Division Budget by $600,000 (for a total appropriation of $33,295,666) to fund the Project (Attachment D) (4/5 vote required).

Reason for Recommended Action/Background

The Division of Integrated Waste Management is required to operate a groundwater extraction well system to create the regulatory required minimum 5-foot separation of groundwater away from the Waste Management Units (WMUs) at the Yolo County Central Landfill (YCCL). On August 31, 2020, the YCCL submitted an Updated Engineering Feasibility Study for Groundwater Separation at the YCCL (Study) to the Central Valley Regional Water Quality Control Board (Water Board). As part of this study, the Division proposed a phased installation of up to 33 additional groundwater extraction wells around the facility with an evaluation period following each phase in the hopes of not needing all 33 wells. The first two phases of additional groundwater extraction wells were completed in 2021 and 2022, respectively, with a total of 11 new wells. Prior to the 2022-2023 wet season, the upgraded extraction well system was keeping the groundwater separation within compliance levels however separation was not maintained during the unusually wet 2022-2023 winter season.  As such, the next phase of expansion contemplated by the Study is now required.  All extracted groundwater is utilized on-site for dust suppression, fire control and crop production.

Based on the results from the 2022-2023 wet season, the Division began preparing a plan for the next phase of extraction well installation. As part of this third phase, 11 additional groundwater extraction wells and installation of ancillary equipment will need to be installed. The intent of this third phase is to increase the groundwater separation in the closed WMUs. The Construction Plans, Specifications, and Engineer’s Estimate were prepared by one of the YCCL’s on-call consultants, WSP. Construction is anticipated to begin in Fall 2023 and be complete in Summer 2024.

The Division budgeted $1,000,000 for the project in the FY2023-24 budget. This estimate was made prior to design and ultimately WSP’s engineer’s estimate (including engineering contingency) is $1,357,263. The Division staff have reviewed WSP’s engineer’s estimate and have confirmed that substantial reduction in overall project cost would severely impact the goals of the new extraction wells. Additionally, the engineer’s estimate does not cover any budget for Construction Contract Change Orders that might arise from unforeseen conditions. The attached Budget Resolution (Attachment D) would increase the capital assets portion of the division budget by $600,000 through use of increased revenue received from liquid waste customers at the YCCL.  The Division is comfortable with this increase in budget allocation since the projected liquid waste revenue for FY23-24 is already exceeding the projected estimates by approximately $1.1 million.

CEQA
The environmental impacts of the Project were analyzed in the Environmental Impact Report certified by the Board of Supervisors on November 9, 2021.  Construction and implementation of the Project will include pertinent mitigation measures for this component of Landfill operations in the certified EIR.

County Counsel has approved the agreement and budget resolution as to form.

Competitive Bid Process/Vendor Performance

The project will be advertised on Bidsync.com for competitive bidding. The competitive bid process will be completed in accordance with State law. Bids will be opened and read publicly at the Department of Community Services-Division of Integrated Waste Management. A contract may only be awarded to the lowest responsive and responsible bidder.

Construction of 2023 Groundwater Extraction Wells will be paid by the Sanitation Enterprise Fund, which is funded through the tipping fees collected at the landfill. There will not be an impact to the general fund. The additional $600,000 expenditure authority needed will come from increased revenue for landfill services.
