Reason for Recommended Action/Background
The County entered into a contract with Benjamin Electric to make various improvements to the Animal Shelter electrical wiring and lighting, which includes adoption, stray, euthanasia and isolation areas and was executed on April 14, 2025. The initial agreement, PO5695, was for a total contract price of $77,439. Two additional change orders were done in which increased the original amount to $82,829. General Services is requesting a third change order for an additional $8,240 at the request of the Department of Community Services-Animal Services to improve the lighting in the puppy and laundry rooms while the electrician is onsite making other related improvements, resulting in a new total contract price of $91,069.
The additional cost for the work described above exceeds the statutory per contract change order limits for Public Contract Code sections 20137 and 20142 because the proposed change order exceeds 10 percent of the original contract prices. Changes exceeding the Public Contract Code change order limits would ordinarily require competitive bidding. However, under Graydon v. Pasadena Redevelopment Agency (1980) 104 Cal.App.3d 631, competitive bidding is not required where the Board finds that such bidding would be unavailing and impractical and would not produce any public advantage. For the following reasons, competitive bidding for the extra lighting work in this case would not have produced any public advantage, and it is in the County and the public’s best interest to work with the existing contractor on the project rather than competitively bidding for the limited project changes.
