Recommended Action

Reason for Recommended Action/Background
Monitoring mercury levels is required under County Code Section 10-5.517 (Mercury Bioaccumulation in Fish) to satisfy the monitoring obligations of the Off-Channel Mining Plan, a component of the Cache Creek Area Plan. This amendment will extend Dr. Slotton's contract for one year and update labor rates. The original contract from 2024 has already been extended once for one year (2025-2026).
The Off-Channel Mining Plan (OCMP) was developed through a collaborative effort involving several key stakeholders. These included aggregate producers such as Teichert, CEMEX, Granite, and Syar Industries, along with the Cache Creek Technical Advisory Committee. Development also required coordination with state regulatory agencies—including the California Department of Fish and Wildlife (CDFW), the Regional Water Quality Control Board, the California Department of Conservation, and the California Native American Heritage Commission—as well as conservation groups like the Cache Creek Conservancy and the Yolo Habitat Conservancy.

Competitive Bid Process/Vendor Performance
January 1, 2024, via a Sole Source, the parties entered into Agreement No. 24-01 (Agreement) with Dr. Slotton to conduct mercury monitoring prescribed by Section 10-5.517 (Mercury Bioaccumulation in Fish) of the County’s Surface Mining and Reclamation Ordinance. Dr. Slotton is the only vendor that can provide the mercury monitoring services required by the County's Surface Mining Reclamation Ordinance. On October 22, 2025, the parties amended the Agreement for one additional year. This second amendment will extend the agreement through the fiscal year 2026-27 and increase the compensation by $210,000 to a new contract maximum of $810,000.

Funding for the mercury monitoring comes from the Aggregate Mining Fees and does not impact the County's general funds. This amendment is in the Department's upcoming budget request.
The total cost of this agreement is $210,000; however, only $200,000 was budgeted in the FY 2026-27 requested budget. Staff will monitor the overall budget in the coming fiscal year and return to the Board during the midyear budget review process to seek budget adjustments as needed.
