Recommended Action
- Approve and authorize the Interim Director of Community Services, or his/her designee, to sign the Flood Maintenance Assistance Program funding agreement in the amount of $113,100 with the California Department of Water Resources for County Service Area No. 6 levee maintenance activities (Attachment A);
- Adopt resolution Accepting Funds (Attachment B); and
- Adopt Local Maintaining Agency Authorizing Resolution (Attachment C).

Reason for Recommended Action/Background
The Knights Landing Levee System is part of the Sacramento River Flood Control Project ("SRFCP"). The SRFCP was authorized by the Flood Control Act of 1917 as Public Law 367 during the 64th Congress, and was later modified in 1928, 1937, and 1941. The Knights Landing levee system consists of three levee segments with a total length of approximately 15.19 miles.
County Service Area No. 6 ("CSA-6"), which was established in 1975 and is governed by the Yolo County Board of Supervisors, is the local maintaining agency responsible for the operations and maintenance ("O&M") of 5.97 miles in the middle of this stretch. CSA-6's responsibility runs along the Sacramento River's right bank from the Knights Landing Ridge Cut outfall gates downstream to the Fremont Weir. The levee is part of Unit No. 127 of the Sacramento River Flood Control Project with O&M standards prescribed by the United States Army Corps of Engineers. All CSA-6 services are paid for by a percentage of property tax.
In late 2018, the California Department of Water Resources ("DWR") announced the creation of a new program -- the Flood Maintenance Assistance Program ("FMAP") -- that made State funds available for Local Maintaining Agencies and Maintenance Areas to perform eligible maintenance activities. The FMAP program was created to ensure that State Plan of Flood Control facilities are properly maintained and have sufficient resources, including funding, to meet applicable federal regulations and O&M manual requirements. An important component of this program is that local matching funds are not required to obtain the State funding.
CSA-6 was awarded $113,100 in FMAP funding by DWR for the 2023 calendar year. These funds will be used for continued implementation of levee maintenance activities that have been funded by the FMAP program dating back to its inception. These activities include, but are not limited to, vegetation control (e.g., weed spraying, tree limbing, and grazing), the removal of critical pipe crossings, gate repairs, and rodent control.
At this time, Staff is recommending that the Board of Supervisors take the following actions:

Staff would like to note that there is a recital in Attachment C that states:
"The County of Yolo acknowledges that it must submit a new operations, maintenance, repair, rehabilitation, and replacement agreement with the Central Valley Flood Protection Board prior to the receipt of Flood Maintenance Assistance Program funds."
The Board of Supervisors approved the above-referenced agreement during their meeting on May 21, 2019 (Resolution No. 19-70 and Agreement No. 19-93). The agreement was fully executed by the Central Valley Flood Protection Board on June 10, 2019. No additional agreements with the Central Valley Flood Protection Board are required to receive the 2023 FMAP funding.

Competitive Bid Process/Vendor Performance
The Competitive Bid Process is not required for the execution of this agreement; however, Natural Resources Division staff will abide by all County Procurement policies when contracting with vendors to perform the work funded by the agreement.
