Reason for Recommended Action/Background

The Board of Supervisors (the “Board”) established “Community Facilities District No. 1989-1 (Davis Branch Library), County of Yolo, State of California” in 1989 (the “CFD”) pursuant to the Mello-Roos Community Facilities Act of 1982, California Government Code Section 53311 et seq. (“the “Act”), by the adoption of Resolution No. 89-101 on June 20, 1989, as augmented by Resolution No. 89-13, for the purpose of expanding and renovating the County’s Davis Branch Library (now known as the “Mary L. Stephens Davis Branch Library”) and providing library services. 

On May 21, 2024, the Board commenced the process to make certain changes to the CFD with the adoption of Resolution No. 24-70 ("Resolution of Consideration").  The Resolution of Consideration set a public hearing on June 25, 2024 to consider changes to the CFD, including increasing the amount of the special tax, amending the authorized facilities and services to be funded by the CFD, and revising the Rate and Method of Apportionment as specified in the exhibits to the Resolution of Consideration. The Board subsequently held a duly noticed public hearing on June 25, 2024 at which all persons interested, including all taxpayers, property owners and registered voters within the CFD, were given an opportunity to appear and to be heard, and the testimony of all interested persons and all taxpayers, property owners and registered voters for or against the Proposal, or any other matters set forth in the Resolution of Consideration, was heard and considered and there was no majority protest to the ballot measure regarding the proposed changes to the CFD.  Having determined there was no majority protest to the proposed changes, the Board adopted Resolution No. 24-88 following the conclusion of the public hearing, which approved a ballot question (now designated as Measure T), calling an election for November 5, 2024 to submit the Measure to the qualified CFD voters, which requires approval by a two-thirds vote.

As stated in Resolution No. 24-88, the proposed ballot question that will appear on the November 5, 2024 ballot is as follows:“To operate two Davis branch libraries (Mary L. Stephens and the new Walnut Park Library in South Davis) — including hours of operation, maintenance, collections, and community programs and services — shall the measure increasing the annual special library tax by $49 per parcel (multifamily parcels would increase by $24.50 per unit), increasing no more than 2% per year, raising approximately $1,070,875 annually, and continuing until ended by the Board of Supervisors, be adopted?”  However, the ballot question inadvertently omitted a ballot title.  While a ballot title is not required, there are anticipated to be additional measures on the November 5, 2024 ballot, including a City of Davis sales tax measure that will appear on the ballots of City of Davis voters along with the Davis Library CFD ballot measure.  To help voters more readily distinguish the measures, the attached Resolution revises the Davis Library CFD measure to add the following ballot title, "Davis Library Measure." The substantive ballot question remains unchanged.
