Recommended Action
- Delegate authority to the County Administrator or designee to approve an agreement with Clarksburg FPD in the amount of $21,254 through June 30, 2025 for the purposes of covering the costs of the Proposition 218 election to support fire service sustainability efforts in the district; and

Reason for Recommended Action/Background
In May 2022, the County entered into an agreement with SCI Consulting Group to develop engineers' reports and perform Proposition 218 elections for willing fire protection districts. The agreed-upon scope of work totaled $296,472 and included planning, compilation of engineers' reports, and balloting for all 15 rural fire protection districts. The initial scope also included community outreach and polling/surveying support for districts that expressed support for those services during contract development. This effort was supported by cannabis tax revenues. On March 12, 2024, the Board of Supervisors approved the first amendment to Agreement No. 1546 with SCI, Inc. This increases the maximum compensation for Prop 218: Planning, Assessment Engineering, Balloting and Community Outreach to $344,527. The agreement term was also extended through June 30, 2025. As of today, eight Fire Protection Districts have completed a Prop 218 election five of which were successful, and three which were not.
The Clarksburg Fire Protection District (FPD) was formed in 1946. Clarksburg FPD has a special assessment (Prop 218) established in 2002. However, for the new Prop 218 assessment, Clarksburg FPD decided not to proceed with SCI and instead have opted to retain their own consultant, DCC Engineering, to develop the engineer’s report. Assuming normal time frames, Clarksburg FPD expects the completion of the Engineer’s Report by March 2025. Recently, Clarksburg FPD requested funds to conduct the election, outreach, collateral materials, etc. that remains budgeted for Clarksburg FPD in the SCI contract of which there is a remaining balance of $21,254. Staff recommends funding this request as the County has covered the cost of the fire sustainability Proposition 218 elections for all other districts. Furthermore, staff recommends delegating authority to the County Administrator or designee to approve an agreement with Clarksburg FPD in the amount of $21,254 through June 30, 2025 for the purposes of covering the costs of the Proposition 218 election to support fire service sustainability efforts in the district.
Approval of the agreement with Clarksburg FPD would require a commensurate reduction of the SCI contract. As such, staff is also recommending the Board approve an amendment to the SCI contract reducing it by $21,254 to a total maximum of $332,773 (Att. A).
